TITLE OF BILL:

An act to amend the racing, pari-mutuel wagering and breeding law, in
relation to the discretionary spending threshold for regional off-track
betting corporations on food products

 
PURPOSE OR GENERAL IDEA OF BILL:

To authorize the increase the discretionary buying threshold from
$15,000 to the threshold of a state agency.

 
SUMMARY OF PROVISIONS:

Section 1 of this bill amends section 507 of the racing, pari-mutuel
wagering and breeding law.

Section 2 of this bill provides the effective date.

JUSTIFICATION:

Essentially, the discretionary buying threshold for Suffolk OTB, which
is $15,000, hasn't been raised since the 1970s and is causing unneces-
sary challenges to operate a large hotel and casino. We are seeking to
have the same thresholds as municipalities of $35,000 for contracts
involving public works and $20,000 for all other contracts.

Suffolk OTB is a public benefit corporation committed to responsible
financial practices that best serve our state and local taxpayers, as
well as contribute to the betterment of the surrounding community.

With approximately 5,000 visitors each day, Jake's 58 Casino Hotel could
be a stronger partner for Long Island's agricultural and fishing small
business sectors, but it is hindered by the State's competitive bidding
process, which often favors large wholesalers and manufacturers.

Per State Finance Law Section 163, subsection 6, state agencies are
permitted to purchase commodities that are "food, including milk and
milk products, or animal or plant fiber products, grown, produced,
harvested, or processed in New York state or textile products manufac-
tured from animal or plant fiber grown or produced predominantly in New
York state in an amount not to exceed two hundred thousand dollars,
without a formal competitive process."

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:

This bill will no fiscal impact to the State and no fiscal impact to
local governments.

 
EFFECTIVE DATE:
This act shall take effect on the first of April next succeeding the
date on which it shall have become a law.

 AN  ACT  to  amend the racing, pari-mutuel wagering and breeding law, in
   relation to the discretionary spending  threshold  for  regional  off-
   track betting corporations on food products

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 1 of section 507  of  the  racing,  pari-mutuel
 wagering  and  breeding  law,  as  amended by chapter 286 of the laws of
 1985, is amended to read as follows:
   1. A. Each corporation shall let contracts  for  construction  or  any
 other  work,  including the furnishing of materials or supplies incident
 thereto, and contracts for the purchase  or  procurement  of  equipment,
 materials or supplies: (i) in the manner provided by law with respect to
 the  letting  of such contracts by counties [except that where the esti-
 mated expense of a contract does not exceed  fifteen  thousand  dollars,
 such  contract  may  be  entered into without public letting], provided,
 however, that where the  corporation  determines  with  respect  to  any
 contract that it would not be in the public interest to comply with this
 section  and  the  governing body of each county, by resolution, rule or
 regulation adopted by the vote of two-thirds  of  the  whole  number  of
 votes  authorized to be cast by all of the members of such body, concurs
 in such determination, then it may  enter  into  such  contract  without
 public  letting as authorized by said resolution, rules and regulations;
 (ii) in conjunction with one or more regional off-track  betting  corpo-
 rations  pursuant  to  this  section; or (iii) in the manner provided in
 section six hundred nine of this chapter if in conjunction with the  New
 York city off-track betting corporation.
   B.  NOTWITHSTANDING  ANY  OTHER  PROVISION  OF  LAW TO THE CONTRARY, A
 CORPORATION SHALL HAVE THE DISCRETIONARY SPENDING THRESHOLD OF  A  STATE
 AGENCY AS PROVIDED IN SUBDIVISION SIX OF SECTION ONE HUNDRED SIXTY-THREE
 OF THE STATE FINANCE LAW, AS IT RELATES TO COMMODITIES WHICH ARE CONSID-
 ERED  FOOD,   INCLUDING MILK AND MILK PRODUCTS, OR ANIMAL OR PLANT FIBER
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.
