TITLE OF BILL:

An act to amend chapter 154 of the laws of 1921 relating to the port
authority of New York and New Jersey, in relation to toll reimbursement
for all represented and non-represented persons employed by the port
authority of New York and New Jersey

 
PURPOSE:

To provide toll reimbursement to Port Authority employees residing in
areas where public transportation is limited or non-existent.

 
SUMMARY OF PROVISIONS:

Section 1 of the bill defines Port Authority of New York and New Jersey
employee and defines port authority.port district. Section 2 states that
every port authority employee shall be reimbursed for mandatory toll
charges incurred while entering and traveling within the port authority
port district. Section 3 states hat Port Authority employees shall be

entitled to non-revenue E-Zpass exclusively for commutation only.

 
JUSTIFICATION:

This legislation has been brought forth by the Port Authority PBS, a
union which represents the largest amount of Port Authority of NY & NJ
employees, in an effort to retain, expand and diversify the agency. This
legislation codifies into law a necessary reimbursement that has been
provided to Port Authority of NY & NJ employees for nearly a century.
Many Port Authority of NY & NJ employees reside in areas where public
transportation is limited or non-existent. Many others work hours that
are not conducive to public transportation schedules. Over the past
several years the Port Authority of NY & NJ has shown a desire to scale
back this reimbursement, which would have a negative effect on the
recruitment and retention of agency employees.

EFFECTIVE DATE:
This act shall take effect upon the enactment into law by the state of
New Jersey of legislation having an identical effect.

   printed to be committed to the Committee on Transportation
 
 AN ACT to amend chapter 154 of the laws of 1921  relating  to  the  port
   authority  of  New York and New Jersey, in relation to toll reimburse-
   ment for all represented and non-represented persons employed  by  the
   port authority of New York and New Jersey

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 1 of chapter 154 of the laws of  1921  relating  to
 the port authority of New York and New Jersey is amended by adding a new
 article XXIII to read as follows:
                               ARTICLE XXIII
                            TOLL REIMBURSEMENT
   1. THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS:
   (A) "PORT AUTHORITY OF NEW YORK AND NEW JERSEY EMPLOYEE" SHALL INCLUDE
 EVERY PERSON, BY WHATSOEVER TITLE, DESCRIPTION OR DESIGNATION KNOWN, WHO
 RECEIVES  ANY  PAY,  SALARY  OR  COMPENSATION  OF ANY KIND FROM THE PORT
 AUTHORITY OF NEW YORK AND NEW JERSEY.
   (B) "PORT AUTHORITY PORT DISTRICT" IS THE GEOGRAPHICAL AREA WITHIN THE
 TWENTY-FIVE MILE RADIUS OF THE  STATUE  OF  LIBERTY  NATIONAL  MONUMENT,
 ENCOMPASSING A TOTAL OF FIFTEEN HUNDRED SQUARE MILES.
   2.  DURING  COMMUTATION  TO AND FROM A WORK ASSIGNMENT WITHIN THE PORT
 AUTHORITY PORT DISTRICT, EVERY PORT AUTHORITY OF NEW YORK AND NEW JERSEY
 EMPLOYEE, BOTH REPRESENTED AND NON-REPRESENTED SHALL BE  REIMBURSED  FOR
 MANDATORY  TOLL CHARGES INCURRED WHILE ENTERING AND TRAVELING WITHIN THE
 PORT AUTHORITY PORT DISTRICT.
   3. PORT AUTHORITY OF NEW YORK AND NEW JERSEY EMPLOYEES SHALL BE  ENTI-
 TLED TO NON-REVENUE E-ZPASS OR A SUCCESSOR DEVICE EXCLUSIVELY FOR COMMU-
 TATION  ONLY.  UNLESS  OTHERWISE  DEFINED IN A REPRESENTED MEMORANDUM OF
 AGREEMENT WITH THE PORT AUTHORITY OF NEW YORK AND  NEW  JERSEY.  A  PORT
 AUTHORITY  OF  NEW  YORK AND NEW JERSEY EMPLOYEE SHALL SURRENDER E-ZPASS
 UPON RETIREMENT, RESIGNATION OR TERMINATION.
   § 2. This act shall take effect upon the enactment  into  law  by  the
 state  of New Jersey of legislation having an identical effect with this

 act, but if the state of New Jersey  shall  have  already  enacted  such
 legislation,  this  act shall take effect immediately; provided that the
 state of New Jersey shall notify the legislative bill  drafting  commis-
 sion  upon  the  occurrence of the enactment of the legislation provided
 for in section one of this act in order that the commission may maintain
 an accurate and timely effective data base of the official text  of  the
 laws  of  the  state  of  New  York  in  furtherance of effectuating the
 provisions of section 44 of the legislative law and section 70-b of  the
 public officers law.
