BILL NUMBER: S9003 SPONSOR: MAY TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises PURPOSE OR GENERAL IDEA OF BILL: This bill will authorize the issuing of a retail liquor license to a business in the Village of North Syracuse, in Onondaga County. SUMMARY OF PROVISIONS: Section 1: Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-16) to authorize the issuing of a retail license for on-premises consumption for a premises which shall be located within two hundred feet of a building occupied as a church, synagogue or other place of worship, provided such premises constitute a premises for the sale of food or beverages at retail for consumption on the premises located wholly within the boundaries of

MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business AN ACT to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-16) to read as follows: (E-16) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDI- VISION, THE AUTHORITY MAY ISSUE A RETAIL LICENSE FOR ON-PREMISES CONSUMPTION FOR A PREMISES WHICH SHALL BE LOCATED WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED AS A CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP, PROVIDED SUCH PREMISES CONSTITUTE A PREMISES FOR THE SALE OF FOOD OR BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE COUNTY OF ONONDAGA, BOUNDED AND DESCRIBED AS FOLLOWS: ALL THAT CERTAIN TRACT, PIECE OR PARCEL OF LAND, SITUATE, LYING AND BEING IN THE VILLAGE OF NORTH SYRACUSE, COUNTY OF ONONDAGA AND STATE OF NEW YORK, BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A DRILL HOLE IN THE SIDEWALK NEAR THE NORTHWESTERLY CORNER OF THE BUILDING LOCATED AT THE SOUTHEASTERLY COMER OF SOUTH MAIN STREET AND CHURCH STREET, IN THE VILLAGE OF NORTH SYRACUSE, NEW YORK, THENCE SOUTH. TWENTY-EIGHT DEGREES, FIFTY MINUTES WEST, ALONG THE EAST- ERLY BOUNDS OF THE STREET KNOWN AS SOUTH MAIN STREET, 48.81 FEET TO THE CONTINUATION OF THE NORTHERLY EDGE OF THE CONCRETE BLOCK BUILDING NOW LEASED TO THE AMERICAN STORES COMPANY; THENCE SOUTH. SIXTY-TWO DEGREES 51 MINUTES AND 30 SECONDS EAST, 94.31 FEET TO A STAKE; THENCE SOUTH, ELEVEN DEGREES 01 MINUTES AND 50 SECONDS WEST, 31.58 FEET TO A STAKE; THENCE SOUTH, SIXTY-TWO DEGREES, FIFTY-EIGHT MINUTES AND TEN SECONDS EAST, 45.97 FEET TO A STAKE SET IN THE EASTERLY LINE OF FARM LOT NO. 79 OF THE TOWN OF CLAY, BEING THE TOWN LINE BETWEEN THE TOWNS OF CLAY AND CICERO.
