TITLE OF BILL:

An act to amend the public authorities law, in relation to requiring the
power authority of the state of New York to post on its website and
develop a corresponding mobile application with information on electric
vehicle charging stations

 
PURPOSE:

Requires publicly available information on electric vehicle charging
stations.   
SUMMARY OF PROVISIONS:

Section 1 amends subdivision 9-a of section 1005 of the public authori-
ties law to require that the power authority of the state of New York
post on its website and develop a corresponding mobile application with
information, including but not limited to: a map with the addresses of
each electric vehicle charging station in the state, the type of elec-
tric vehicle charger, whether the charging station is located in a park-
ing lot, parking garage or on a street, whether there are fees required

to use a charging station, whether there is a fee to enter a lot where
the charging station is located, whether the charging station is public-
ly available, and whether a charging station is out of service or other-
wise unavailable, updated no less than monthly.

Section 2 states the effective date.

 
JUSTIFICATION:

Electric Vehicles (EVs) are critical to our transition to a green econo-
my and reduce the emission of greenhouse gasses that cause climate
change. The successful transition to widespread EV adoption is reliant
on sufficient charging infrastructure. One of the biggest deterrents for
consumers who are considering buying EVs is the lack of reliable infor-
mation on charging stations.

Volvo Car USA and Harris Poll teamed up to create a survey to provide
new insights on the public reception to electric vehicles. 49% of people
polled said their top barrier to purchasing an EV was the low availabil-
ity of charging stations, while 61% said more charging stations would
increase their likelihood to purchase an EV.  Motorists need reliable
and accurate information about charging stations. New York can support
the tranistion to EVs by creating an app and corresponding website with
detailed information on EV charging station locations, if they are in a
parking garage, lot, or street, if there is a paywall to access the
station, and the type of charger.  Keeping drivers informed of their
options will support further EV use, and ease the burden on people who
already drive EVs.

 AN ACT to amend the public authorities law, in relation to requiring the
   power  authority  of  the state of New York to post on its website and
   develop a corresponding mobile application with information  on  elec-
   tric vehicle charging stations
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 9-a of section 1005 of the  public  authorities
 law, as added by section 1 of part KK of chapter 58 of the laws of 2019,
 is amended to read as follows:
   9-a.  (A) As deemed feasible and advisable by the trustees, to design,
 finance, develop, construct, install, lease, operate and maintain  elec-
 tric  vehicle  charging  stations  throughout  the  state for use by the
 public. The authority shall annually post on their website a  report  on
 those  activities undertaken pursuant to this subdivision, including but
 not limited to: the total number of electric vehicle  charging  stations
 in  operation  pursuant  to  such  authorization,  the locations of such
 charging stations, and the total costs to the authority associated  with
 such activities.
   (B)  IN  ADDITION TO THE INFORMATION REQUIRED IN PARAGRAPH (A) OF THIS
 SUBDIVISION, THE AUTHORITY SHALL ALSO POST ON ITS WEBSITE AND DEVELOP  A
 CORRESPONDING  MOBILE  APPLICATION  WITH  INFORMATION, INCLUDING BUT NOT
 LIMITED TO: A MAP WITH THE ADDRESSES OF EACH ELECTRIC  VEHICLE  CHARGING
 STATION  IN THE STATE, THE TYPE OF ELECTRIC VEHICLE CHARGER, WHETHER THE
 CHARGING STATION IS LOCATED IN A PARKING LOT, PARKING  GARAGE  OR  ON  A
 STREET,  WHETHER  THERE  ARE  FEES  REQUIRED  TO USE A CHARGING STATION,
 WHETHER THERE IS A FEE TO ENTER A LOT  WHERE  THE  CHARGING  STATION  IS
 LOCATED, WHETHER THE CHARGING STATION IS PUBLICLY AVAILABLE, AND WHETHER
 A  CHARGING  STATION  IS  OUT  OF  SERVICE OR OTHERWISE UNAVAILABLE. THE

TITLE OF BILL:

An act to amend the public authorities law, in relation to requiring the
New York State energy research and development authority to develop a
real-time mobile application with a corresponding map with information
on electric vehicle charging stations and to make such information
available on the authority's website

 
PURPOSE OF THE BILL:

To direct the New York State Energy Research and Development Authority
(NYSERDA), in consultation with the Department of Public Service (DPS)
and the New York Power Authority (NYPA), to develop a real-time, inter-
active electric vehicle charging station mapping mobile application with
corresponding information on the authority's website. The mobile appli-
cation will include: an interactive map of all the publicly available
electric vehicle charging stations in the state with GPS capability, the
number of stations at each location, the operability status including
whether the stations are in use or out of service, whether the charging
station is a level 2 or level 3 fast charger, plug or vehicle compat-

ibility, operating hours, price per kWh to charge, the operating compa-
nies name and contact information to report any operation issues, wheth-
er the charging stations are located in a parking lot, parking garage or
on the street, and whether there is a fee to enter the lot where the
stations are located.

 
SUMMARY OF PROVISIONS:

Section 1 amends the Public Authorities Law to add a new section 1885
directing NYSERDA, in consultation with the Department of Public Service
(DPS) and the New York Power Authority (NYPA), to develop an interactive
electric vehicle charging station mapping mobile application and post
corresponding information on their website.

Section 2 states the effective date.

 
JUSTIFICATION:

New York State, through the passage of the Climate Leadership and Commu-
nity Protection Act (CLCPA) in 2019, demonstrated our commitment to
economy-wide decarbonization. In order to decarbonize the transportation
sector, the deployment of plug-in hybrid and all electric vehicles will
be increasingly important.

New York State has established a goal of reaching 850,000 zero-emission
vehicles by 2025, and a goal for all new passenger vehicles to be zero-
emission by 2035. In order to facilitate the necessary deployment of
zero-emission vehicles, New York State must ensure that electric vehicle
(EV) charging stations are operational and easily accessible in order to
reduce "range anxiety", one of the key barriers to EV adoption.

According to a 2022 study by Hudson Valley Pattern for Progress, drivers
rely on multiple smartphone apps to find EV chargers throughout the
state. These apps vary in the amount of information available and often
do not include the operational status of the EV charging stations. This

legislation will create a one-stop-shop for EV drivers to easily access
information on all publicly available EV chargers in New York State.

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  public  authorities  law  is amended by adding a new
 section 1885 to read as follows:
   § 1885. ELECTRIC VEHICLE CHARGING STATION INTERACTIVE  MAP.    1.  THE
 AUTHORITY, IN CONSULTATION WITH THE DEPARTMENT OF PUBLIC SERVICE AND THE
 POWER  AUTHORITY OF THE STATE OF NEW YORK, SHALL POST ON ITS WEBSITE AND
 DEVELOP A CORRESPONDING MOBILE APPLICATION WITH INFORMATION ON  ELECTRIC
 VEHICLE CHARGING STATIONS AVAILABLE FOR PUBLIC UTILIZATION. THIS WEBSITE
 AND CORRESPONDING MOBILE APPLICATION SHALL INCLUDE AT A MINIMUM:
   (A)  AN  INTERACTIVE  MAP  WITH THE ADDRESSES OF EACH ELECTRIC VEHICLE
 CHARGING STATION IN THE STATE  AVAILABLE  FOR  PUBLIC  UTILIZATION  THAT
 INCLUDES GLOBAL POSITIONING SYSTEM (GPS) CAPABILITY;
   (B) THE NUMBER OF CHARGING STATIONS IN EACH LOCATION;
   (C)  TO  THE  EXTENT  FEASIBLE,  THE  OPERABILITY  STATUS  OF CHARGING
 STATIONS, INCLUDING WHETHER CHARGING STATIONS ARE CURRENTLY IN  USE  AND
 WHETHER CHARGING STATIONS ARE OUT OF SERVICE OR OTHERWISE UNAVAILABLE;
   (D)  WHETHER CHARGING STATIONS ARE LEVEL TWO OR LEVEL THREE FAST CHAR-
 GERS;
   (E) PLUG OR VEHICLE COMPATIBILITY INFORMATION;
   (F) OPERATING HOURS;

 LOCATED AND, IF APPLICABLE, THE FEE; AND
   (J)  THE  OPERATING COMPANY NAME AND CONTACT INFORMATION TO REPORT ANY
 OPERATIONAL ISSUE WITH CHARGING STATIONS.
   2. THE AUTHORITY,  IN  CONSULTATION  WITH  THE  DEPARTMENT  OF  PUBLIC
 SERVICE  AND  THE POWER AUTHORITY OF THE STATE OF NEW YORK, SHALL UPDATE
 THE INFORMATION ON THE WEBSITE AND CORRESPONDING MOBILE  APPLICATION  NO
 LESS THAN ONCE PER MONTH.
   §  2.   This act shall take effect on the ninetieth day after it shall
 have become a law.
