AN ACT to amend the public health law, in relation to information that
residential health care facilities are required to provide to resi-
dents and their families
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 13 of section 2803 of the public health law, as
added by chapter 344 of the laws of 2021, is amended to read as follows:
13. The commissioner shall require each residential health care facil-
ity to provide residents and their families with a separate document, as
part of an intake application, in no less than twelve-point font, that
includes information on how a potential resident and their family
members can look up complaints, citations, inspections, enforcement
actions, and penalties taken against the facility, including the web
address for the New York state nursing home profiles website that is
maintained by the department and the nursing home compare website main-
tained by the United States department of health and human services, if
applicable. SUCH INFORMATION SHALL ALSO INCLUDE AN EXPLANATION OF THE
OWNERSHIP STRUCTURE OF THE FACILITY, INCLUDING THE CURRENT BOARD OF
DIRECTORS AND MEMBERS OF THE LIMITED LIABILITY ENTITY, AND ANY CONTRAC-
TORS INVOLVED WITH MAJOR FUNCTIONS OF THE FACILITY, INCLUDING STAFFING,
FOOD, AND LINEN SERVICE. EACH RESIDENTIAL HEALTH CARE FACILITY SHALL
ALSO POST SUCH INFORMATION ON THE FACILITY'S WEBSITE. THE COMMISSIONER
SHALL PUBLISH INFORMATION RELATED TO THE FACILITY'S OWNERSHIP STRUCTURE
AND CONTRACTORS, AS PROVIDED BY SUCH FACILITY, ON THE NEW YORK STATE
NURSING HOME PROFILES WEBSITE.
§ 2. This act shall take effect immediately.
