S T A T E O F N E W Y O R K ________________________________________________________________________ 7560 2025-2026 Regular Sessions I N A S S E M B L Y April 1, 2025 ___________ Introduced by M. of A. SANTABARBARA -- read once and referred to the Committee on People with Disabilities AN ACT to amend the mental hygiene law, in relation to requiring the developmental disabilities advisory council to submit an annual report on the state's service delivery system for individuals with intellec- tual and developmental disabilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 13.05 of the mental hygiene law is amended by adding a new subdivision (h) to read as follows: (H) THE DEVELOPMENTAL DISABILITIES ADVISORY COUNCIL SHALL SUBMIT A REPORT YEARLY TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY ON THE STATE'S SERVICE DELIVERY SYSTEM FOR INDIVIDUALS WITH INTELLECTUAL AND DEVELOPMENTAL DISABILITIES. SUCH REPORT SHALL BE DELIVERED BY THE THIRTY-FIRST OF DECEMBER OF EACH CALEN- DAR YEAR AND SHALL BE MADE AVAILABLE TO THE PUBLIC. SUCH REPORT SHALL INCLUDE, AT MINIMUM: 1. OUTCOMES AND IMPACTS OF EXISTING PROGRAMS; 2. POLICY AND BUDGET PRIORITIES BASED ON STAKEHOLDER INPUT; 3. IDENTIFIED GAPS IN SERVICES DELIVERY; AND 4. RECOMMENDATIONS FOR IMPROVING SERVICES. § 2. RECOMMENDATIONS MADE TO THE COMMISSIONER RELATED TO STATEWIDE PRIORITIES AND GOALS FOR SERVICES FOR INDIVIDUALS WITH DEVELOPMENTAL DISABILITIES, AND THE IMPLEMENTATION OF THE STATEWIDE COMPREHENSIVE PLAN AS REQUIRED UNDER SECTION 5.07 OF THIS CHAPTER; AND 3. ANY OTHER ACTIONS TAKEN BY THE COUNCIL RELATED TO THEIR DUTIES. § 2. This act shall take effect immediately.
