PHEFFER AMATO -- read once and referred to the Committee on Governmental Employees AN ACT to amend the civil service law, in relation to comparable salary and other benefits for state employees designated managerial or confi- dential THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The civil service law is amended by adding a new section 137 to read as follows: § 137. COMPARABLE SALARY AND OTHER BENEFITS. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, STATE EMPLOYEES DESIGNATED MANAGERIAL OR CONFIDENTIAL UNDER ARTICLE FOURTEEN OF THIS CHAPTER SHALL RECEIVE PERFORMANCE ADVANCEMENT ADJUSTMENTS EQUIVALENT TO ONE SIXTH OF THE SALA- RY RANGE FOR SUCH EMPLOYEE'S SALARY GRADE ON APRIL FIRST OF EACH FISCAL YEAR FOLLOWING COMPLETION OF EACH YEAR OF SERVICE IN GRADE. AS A RESULT OF SUCH ADJUSTMENT, NO EMPLOYEE SALARY SHALL EXCEED THE JOB RATE OF THEIR SALARY GRADE. PERFORMANCE ADVANCEMENT ADJUSTMENTS DUE ANY MANAGE- RIAL OR CONFIDENTIAL EMPLOYEE SHALL NOT BE WITHHELD UNLESS AN EMPLOYEE HAS RECEIVED A FORMAL WRITTEN PERFORMANCE EVALUATION RATING OF UNSATIS- FACTORY OR ITS EQUIVALENT. § 2. This act shall take effect on the first of April next succeeding the date on which it shall have become a law.
