TITLE OF BILL:

An act designating Richard Ernyey eligible to take the competitive civil
service examination for the position of police officer

 
PURPOSE:

To designate Richard Ernyey eligible to take the competitive civil
service examination for the position of police officer.

 
SUMMARY OF PROVISIONS:

Section I. Establishes the provisions that Richard Ernyey be eligible to
take the competitive civil service examination for the position of
police officer for the city of New York, and contingent upon his score
of examination, be eligible for placement on the eligible list for
appointment as a full-time police officer.

Section 2. Establishes that Richard Ernyey shall be subject to the merit

and fitness provisions of the civil service law and the administrative
code of the city of New York.

Section 3. Establishes the effective date.

 
JUSTIFICATION:

Richard Ernyey served on New York City's police force for almost a
decade, before a change in his family's plans required a relocation out
of state. After leaving the department to make the move, family plans
changed and Mr. Ernyey and his family remain in their home state of New
York. He seeks to be reinstated to the City's police department, and
scored competitively on the police officer exam in November 2022.  Upon
his appearance for the next step, his medical exam, he was told he had
aged out by four months. At a time when police officers are in great
need, it would be most prudent for the City to consider Mr. Ernyey's
reassignment to the force, especially considering his prior excellent
service and high exam scores. Mr. Ernyey is ready and eager to serve
again.

 AN ACT designating Richard Ernyey eligible to take the competitive civil
   service examination for the position of police officer

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Notwithstanding the provisions of section 58 of  the  civil
 service  law,  section  14-109 of the administrative code of the city of
 New York, or any other law to the contrary,  Richard Ernyey, born Febru-
 ary 21, 1987, who had been continuously employed by the  police  depart-
 ment of the city of New York from January 9, 2013 to August 28, 2020, as
 a  full-time  police  officer, shall be eligible to take the competitive
 civil service examination for the position of police officer and  shall,
 contingent  upon his score on such examination, be eligible to be placed
 on the eligible list for appointment as a full-time police  officer  for
 the city of New York.
   §  2.  Richard  Ernyey  shall  otherwise  be  subject to the merit and
 fitness provisions of the civil service law and the administrative  code
 of the city of New York applicable to full-time police officers.
   § 3. This act shall take effect immediately.

TITLE OF BILL:

An act authorizing certain former full-time police officers to take the
competitive civil service examination for the position of police officer
for the city of New York

 
PURPOSE:

To allow former full-time police officers to be eligible to take the
civil service examination for the city of New York.

 
SUMMARY OF PROVISIONS:

Section 1 of the bill lists that any former full-time police officer for
the city of New York born between January 1, 1985 and January 1, 1990,
is eligible to take the competitive civil service examination.  Upon
their score, they will be eligible to be placed on the list for appoint-
ment as a full-time police officer for the city of New York.

Section 2 of the bill states that any former full-time police officer
eligible must be subject to the merit and fitness provisions of the
civil service law and the administrative code of the city of New York.

Section 3 establishes the effective date.

 
JUSTIFICATION:

New York City is in dire need of police officers. This bill will assist
the City in recruitment and fulfilling their staffing needs.  By allow-
ing individuals who may have slightly aged out of the current 35 year
age requirement, this would allow for highly qualified individuals who
have prior law enforcement experience to join the force. Covid-19 was an
extreme hindrance for NYPD recruitment, as testing & exams for officers
were halted and severely delayed. This prevented several qualified indi-
viduals who would have otherwise met the age requirement, from being
able to join despite passing all other requirements.
