 AN ACT to amend the  penal law, in relation to the regulation of  pistol
   converters and convertible pistols

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 1 of section 265.00 of the penal law is amended
 and a new subdivision 37 is added to read as follows:
   1. "Machine-gun" means a weapon of any  description,  irrespective  of
 size, by whatever name known, loaded or unloaded, from which a number of
 shots or bullets may be rapidly or automatically discharged from a maga-
 zine  with one continuous pull of the trigger and includes a sub-machine
 gun, AND ALSO INCLUDES ANY CONVERTIBLE PISTOL THAT IS  EQUIPPED  WITH  A
 PISTOL CONVERTER.
   37.  "CONVERTIBLE  PISTOL" MEANS ANY SEMI-AUTOMATIC PISTOL THAT CAN BE
 CONVERTED INTO A MACHINE-GUN SOLELY BY THE INSTALLATION OR ATTACHMENT OF
 A PISTOL CONVERTER.
   § 2. Subdivision 10 of section 265.02 of the penal law,  as  added  by
 chapter  1  of  the laws of 2013, is amended and a new subdivision 11 is
 added to read as follows:
   (10) Such person possesses an unloaded firearm and  also  commits  any
 violent felony offense as defined in subdivision one of section 70.02 of
 this chapter as part of the same criminal transaction[.]; OR
   (11) SUCH PERSON KNOWINGLY POSSESSES ANY PISTOL CONVERTER.
   §  3.  Subdivisions  1  and  2  of section 265.10 of the penal law, as
 amended by chapter 481 of the laws of 2024, are amended and a new subdi-
 vision 10 is added to read as follows:
   1. Any person who  manufactures  or  causes  to  be  manufactured  any
 machine-gun, PISTOL CONVERTER, assault weapon, large capacity ammunition
 feeding  device  or  disguised  gun  is  guilty of a class D felony. Any

 MENT OF A PISTOL CONVERTER.  AS USED IN THIS SUBDIVISION, "COMMON HOUSE-
 HOLD TOOLS" MEANS SCREWDRIVERS, PIPE WRENCHES, PLIERS,  HACKSAWS,  CROW-
 BARS,   ELECTRIC   DRILLS,  HAMMERS,  CHISELS,  AND  CRESCENT  WRENCHES.
 "CONVERTIBLE PISTOL" DOES NOT INCLUDE HAMMER-FIRED SEMI-AUTOMATIC PISTOL
 OR ANY STRIKER-FIRED SEMI-AUTOMATIC PISTOL LACKING A  CRUCIFORM  TRIGGER
 BAR,  WHICH INSTEAD HAS A TRIGGER BAR THAT IS SHIELDED FROM INTERFERENCE
 BY A PISTOL CONVERTER. A POLYMER NOTCH OR OTHER PIECE OF POLYMER  MOLDED
 INTO THE REAR OF A PISTOL FRAME DOES NOT PREVENT READY CONVERSION INTO A

As a current military service member in the state of New York, first responder, and lifelong hunter, I find the proposed legislation targeting so-called “cruciform bar pistols” extremely concerning. The language of this bill is so broad that it would, in effect, outlaw nearly every modern semi-automatic handgun in common use today.
To use a practical example: Glock handguns—arguably the most widely used and trusted pistols for self-defense, law enforcement, and military personnel—have not had any major design “updates” in regard to this issue. Glocks do not have factory auto sears, nor are they designed to be fully automatic. Their only safeguard is a simple polymer block that prevents the use of an aftermarket auto sear. Yet, under the wording of this bill, even these standard-issue Glocks would be outright banned in New York State. With my well versed knowledge in firearms, I understand that any firearm can be converted into a machine gun if enough work is put into it.
This is troubling because Glocks and similar handguns are relied upon daily by law-abiding citizens, first responders, and service members for protection. I personally carry a Glock for my own safety and the safety of my family, as do countless others across this country and state. To suddenly make these pistols illegal would strip away a fundamental and practical tool of self-defense from those who respect and follow the law.
Meanwhile, the individuals this bill is supposedly intended to stop—criminals—will not be deterred. They will continue to obtain Glocks and other handguns outside of New York, unaffected by this law. As a result, the only people harmed are law-abiding citizens who do not want or use auto sears, and who have no interest in converting their firearms illegally.
This legislation will not make our communities safer. Instead, it will disarm responsible citizens while leaving criminals unaffected. I strongly urge reconsideration of this bill in its current form.
