BILL NUMBER: S6426 SPONSOR: MAYER TITLE OF BILL: An act to amend the town law and the public officers law, in relation to authorizing the assistant court clerk and fire marshal of the town of Harrison, county of Westchester, to be nonresidents of such town PURPOSE OF BILL: To waive the residency requirement for the assistant court clerk and fire marshal in the town of Harrison, county of Westchester SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends section 23 of the town law by adding subdivision 37 to allow the assistant court clerk and fire marshal of the town of Harrison to reside outside of the town as long as they reside within Westchester County. MAYER -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the town law and the public officers law, in relation to authorizing the assistant court clerk and fire marshal of the town of Harrison, county of Westchester, to be nonresidents of such town THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 23 of the town law is amended by adding a new subdivision 37 to read as follows: 37. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION ONE OF THIS SECTION, IN THE TOWN OF HARRISON, IN THE COUNTY OF WESTCHESTER, THE PERSON PERFORMING THE FUNCTION OF ASSISTANT COURT CLERK OR FIRE MARSHAL, NEED NOT BE AN ELECTOR OF SUCH TOWN. PROVIDED, HOWEVER, THE PERSON PERFORM- ING THE FUNCTION OF ASSISTANT COURT CLERK OR FIRE MARSHAL IN ANY OTHER TOWN SHALL BE AN ELECTOR OF SUCH TOWN, UNLESS OTHERWISE PROVIDED BY AN ACT OF THE STATE LEGISLATURE. § 2. Section 3 of the public officers law is amended by adding a new subdivision 76 to read as follows: 76. IN THE TOWN OF HARRISON, IN THE COUNTY OF WESTCHESTER, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH SUCH PERSON SHALL BE CHOSEN OR WITHIN WHICH SUCH PERSON'S OFFICIAL FUNC- TIONS ARE REQUIRED TO BE EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE OFFICE OF ASSISTANT COURT CLERK OR FIRE MARSHAL OF THE TOWN OF HARRISON; PROVIDED THAT SUCH PERSON RESIDES IN A TOWN WHICH IS IN THE COUNTY OF WESTCHESTER. PROVIDED, HOWEVER, THE PERSON PERFORMING THE FUNCTION OF ASSISTANT COURT CLERK OR FIRE MARSHAL IN ANY OTHER TOWN SHALL BE A RESIDENT OF SUCH TOWN, UNLESS OTHERWISE PROVIDED BY LAW. § 3.
