 AN  ACT  to amend the public service law, in relation to prohibiting the
   imposition of a system benefits charge on ratepayers' utility bills

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The public service law is amended by adding a new section
 18 to read as follows:
   § 18. PROHIBITION ON SYSTEM BENEFITS CHARGE.  THE COMMISSION SHALL  BE
 PROHIBITED FROM IMPOSING ON RATEPAYERS' UTILITY BILLS A SURCHARGE OF THE
 KIND  DESIGNATED  BY THE COMMISSION AT THE TIME OF THE EFFECTIVE DATE OF
 THIS SECTION AS A SYSTEM BENEFITS CHARGE.
   § 2. This act shall take effect immediately.
