 AN  ACT  to  amend  the  executive  law, in relation to compensation for
   required code enforcement personnel training

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section 376-a of the executive law is amended by adding a
 new subdivision 5 to read as follows:
   5. ALL CODE ENFORCEMENT PERSONNEL  SHALL  BE  PAID  FOR  ANY  TRAINING
 REQUIRED PURSUANT TO THE PROVISIONS OF THIS SECTION AT A RATE SET BY THE
 SECRETARY  OF STATE.  SUCH RATE SHALL NOT BE LESS THAN THE CODE ENFORCE-
 MENT PERSONNEL'S REGULAR RATE OF PAY, OR LESS THAN ANY RATE OF PAY SPEC-
 IFIED IN A COLLECTIVE BARGAINING AGREEMENT COVERING SUCH  CODE  ENFORCE-
 MENT PERSONNEL.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal of any rule or regulation necessary  for  the  implementation  of
 this  act  on its effective date are authorized to be made and completed
 on or before such effective date.

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section 376-a of the executive law is amended by adding a

   5. SUBJECT TO THE AMOUNTS APPROPRIATED  FOR  THIS  PURPOSE,  ALL  CODE
 ENFORCEMENT  PERSONNEL  SHALL BE PAID FOR ANY TRAINING REQUIRED PURSUANT
 TO THE PROVISIONS OF THIS SECTION AT A RATE  SET  BY  THE  SECRETARY  OF
 STATE.    SUCH  RATE SHALL NOT BE LESS THAN THE CODE ENFORCEMENT PERSON-
 NEL'S REGULAR RATE OF PAY, OR LESS THAN ANY RATE OF PAY SPECIFIED  IN  A
 COLLECTIVE  BARGAINING  AGREEMENT COVERING SUCH CODE ENFORCEMENT PERSON-
 NEL.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal  of  any  rule  or regulation necessary for the implementation of
 this act on its effective date are authorized to be made  and  completed
