SUMMARY OF PROVISIONS: Section 1 amends section 3605-b of the public health law to clarify the timeline for submission of the required LHCSA statistical reports. Section 2 is the effective date. RYAN -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the submission of certain reports by licensed home care services agencies THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 1 of section 3605-b of the public health law, as added by section 9-d of part B of chapter 57 of the laws of 2018, is amended to read as follows: (b) A LHCSA that fails to submit a complete and accurate set of all required registration materials by the deadline established by the commissioner shall be required to pay a fee of five hundred dollars for each month or part thereof that the LHCSA is in default. THE DEPARTMENT SHALL MAKE AVAILABLE TO LHCSAS ALL DEPARTMENT PLATFORMS, APPLICATIONS, SOFTWARE, SOFTWARE UPDATES, TEMPLATES, FORMS, AND OTHER DOCUMENTS THAT ARE NECESSARY FOR THE LHCSA TO SUBMIT STATISTICAL REPORTS ASSOCIATED WITH OR RELATED TO SUCH REGISTRATION MATERIALS NO LESS THAN NINETY CALENDAR DAYS PRIOR TO THE DEADLINE ESTABLISHED BY THE COMMISSIONER TO SUBMIT SUCH STATISTICAL REPORTS. A LHCSA that failed to register in the prior year by the deadline of the current year shall not be permitted to register for the upcoming registration period unless it submits any unpaid late fees. § 2.
