BILL NUMBER: S7639 SPONSOR: JACKSON TITLE OF BILL: An act to amend the public officers law, in relation to permitting poli- tical subdivisions and municipal corporations of the state to set the residency requirements for certain positions PURPOSE: This bill seeks to amend Section 3 of the Public Officers law by adding a new subdivision 1-b which would permit political subdivisions and municipal corporations of the state to set the residency requirements for certain positions. SUMMARY OF PROVISIONS: By amending Section 3 of the Public Officers law, public officers may no longer be required to live within the political subdivision or municipal corporation that they serve.

JACKSON, C. RYAN -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Government Operations AN ACT to amend the public officers law, in relation to permitting poli- tical subdivisions and municipal corporations of the state to set the residency requirements for certain positions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3 of the public officers law is amended by adding a new subdivision 1-b to read as follows: 1-B. NOTWITHSTANDING ANY PROVISIONS OF THIS SECTION OR OF ANY GENERAL, SPECIAL OR LOCAL LAW, CHARTER, CODE, ORDINANCE, RESOLUTION, RULE OR REGULATION, REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDI- VISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH SUCH PERSON SHALL BE CHOSEN OR WITHIN WHICH THEIR OFFICIAL FUNCTIONS ARE REQUIRED TO BE EXERCISED, THE LEGISLATIVE BODY OF A POLITICAL SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE MAY BY LOCAL LAW, ORDINANCE OR RESOLUTION, SET OR WAIVE SUCH RESIDENCY REQUIREMENTS. § 2.
