TITLE OF BILL:

An act in relation to authorizing Nicole Longo to take the competitive
civil service examination for the position of police sergeant and be
placed on the eligible list for employment as a full-time police
sergeant for the village of Bronxville

 
PURPOSE OF BILL:

To allow Nicole Longo to sit for a promotional civil service examination
for which she would otherwise be eligible but for an exclusion of her
prior service with the New York City Police Department (NYPD) from the
48-month service requirement.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section one of the bill provides that, notwithstanding any law, rule, or
regulation to the contrary, Nicole Longo shall be deemed to have satis-
fied any service requirement necessary to sit for the promotional civil
              

service examination for the position of police sergeant.

Section two subjects Nicole Longo to the applicable merit and fitness
provisions of the applicable civil service law.

Section three sets the effective date.

 
JUSTIFICATION:

Nicole Longo served with distinction for more than six years in a quali-
fying title with the New York City Police Department and will complete
her third year of service with the Bronxville Police Department in
December 2025. At which point, Police Officer Longo will have nine years
of combined service.

However, her prior years of service with the NYPD are not taken into
account toward the 48-month requirement to sit for a civil service exam-
ination for which she is otherwise qualified. Under current law, these
years would be counted, but Police Officer Longo was hired in the year
prior to the enactment of the law that allowed for this service credit
and is therefore unable to qualify to sit for the examination.

This outcome is inconsistent with the intent and spirit of the merit-
based civil service system, which aims to reward professional experience
and dedication to public service. Police Officer Longo's siA ttAts,of
service with the NYPD were in substantially similar functions and
responsibilities to those required by the examination in question. Deny-
ing her eligibility undermines the equitable treatment of civil servants
with interagency experience.

This bill is narrowly tailored to address the unique circumstances of
this individual and does not alter the general requirements applicable
to other candidates.
