BILL NUMBER: S8076 SPONSOR: SKOUFIS TITLE OF BILL: An act directing the commissioner of education to conduct a study of recess held in elementary schools in kindergarten through grade six PURPOSE: Directs the commissioner of education to conduct a study of recess held in elementary schools in kindergarten through grade six SUMMARY OF PROVISIONS: Section 1: The commissioner of education is directed to conduct a study of recess held in elementary schools from kindergarten through grade six. This study will include a survey collecting data on how many districts offer recess, its frequency and duration, and whether it occurs indoors or outdoors. It will also examine whether dedicated spac- es are provided, if recess is supervised, the challenges schools face in offering recess, and whether it includes structured or unstructured

SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT directing the commissioner of education to conduct a study of recess held in elementary schools in kindergarten through grade six THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The commissioner of education is directed to conduct a study of recess held in elementary schools from kindergarten through grade six. Such commissioner shall conduct a survey as part of such study which shall include, but not be limited to: (a) information pertaining to the number of school districts currently offering recess; (b) the length of such recess and how often it is provided; (c) information pertaining to the location of such recess, including whether such recess is held indoors or outdoors; (d) if districts provide a dedicated space for such recess; (e) if the school district's recess is supervised or unsupervised; (f) what the barriers are to providing recess; and (g) if such recess is structured and if students are offered time for unstructured play. § 2. On or before December 31, 2025, the commissioner of education shall prepare a report of their findings from such study. Such report shall be forwarded to the governor, the temporary president of the senate, the speaker of the assembly, the senate minority leader, the assembly minority leader, and the chairpersons and ranking members of the senate and assembly committees on education. Such report shall also be released on the public website of the New York state education department. § 3. This act shall take effect immediately.
