BILL NUMBER: S8103 SPONSOR: COMRIE TITLE OF BILL: An act to amend the financial services law, in relation to enacting the "department of financial services open data act" PURPOSE: Requires that the Department of Financial Services comply with Executive Order 95 of 2013 by making publicly available all publishable data. SUMMARY OF PROVISIONS: Section 1: Act Title Section 2: Legislative Findings Section 3: Amends financial services law to require publishing of all data the publishing of which would not violate statute or regulation.

S T A T E O F N E W Y O R K ________________________________________________________________________ 8103 2025-2026 Regular Sessions I N S E N A T E May 15, 2025 ___________ Introduced by Sen. COMRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Banks AN ACT to amend the financial services law, in relation to enacting the "department of financial services open data act" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. This act shall be known and may be cited as the "department of financial services open data act". § 2. Legislative findings. The legislature finds that the release of data, in a format that is easily accessible, understandable and usable by the public, can increase civic engagement with government. In addi- tion, in a department providing a public service and operating an enter- prise as vital as that of the Department of Financial Services, trans- parency in data is in the public's best interest. It is the intent of the legislature that the department and its subsidiaries release as much data as is feasible in open formats, so that the public can access that data, analyze it, and engage with the department with suggestions and solutions to improve its operations. § 3. The financial services law is amended by adding a new section 208 to read as follows: § 208. OPEN DATA REPORTING. (A) THE DEPARTMENT SHALL FULLY COMPLY WITH THE PROVISIONS OF EXECUTIVE ORDER 95 OF 2013, "USING TECHNOLOGY TO PROMOTE TRANSPARENCY, IMPROVE GOVERNMENT PERFORMANCE AND ENHANCE CITIZEN ENGAGEMENT", AND SHALL PROVIDE THE NEW YORK STATE OFFICE OF INFORMATION TECHNOLOGY SERVICES AND THE LEGISLATURE ALL DATA AS DEFINED IN SUBSECTION (B) OF THIS SECTION. (B) FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (1) "OPEN DATA WEBSITE" SHALL MEAN THE WEBSITE DATA.NY.GOV OR SUCH OTHER SUCCESSOR WEBSITE MAINTAINED BY, OR ON BEHALF OF, THE STATE, AS DEEMED APPROPRIATE BY THE NEW YORK STATE OFFICE OF INFORMATION TECHNOLO- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
