BILL NUMBER: S8243 SPONSOR: HINCHEY TITLE OF BILL: An act to amend the agriculture and markets law, in relation to the suspension of collection of the produce security fund PURPOSE The purpose of this bill is to increase the Producer Security Fund license fee collection cap from $4 million to $6 million to provide the same level of security to producers as provided by the current statutory cap when adjusted for inflation. It would also grant the Department of Agriculture and Markets (Department) the authority to continue collect- ing security fund licensing fees in the event the proposed cap of $6 million is reached in order to provide, when adjusted for inflation, the same level of protection intended by the Legislature. HINCHEY -- (at request of the Department of Agricul- ture and Markets) -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to the suspension of collection of the produce security fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (f) of subdivision 1 of section 250 of the agri- culture and markets law, as amended by chapter 288 of the laws of 1999, is amended to read as follows: (f) (I) At any time the fund exceeds [four] SIX million dollars on the one hundred twentieth day prior to the commencement of the next license year, the commissioner shall suspend collection of the security fund fee, unless [he or she] SUCH COMMISSIONER has reason to believe that pending claims may reduce the fund below that amount. (II) IN THE EVENT THAT THE FUND EXCEEDS SIX MILLION DOLLARS ON THE ONE HUNDRED TWENTIETH DAY PRIOR TO THE COMMENCEMENT OF THE NEXT YEAR, BUT WHEN ADJUSTED FOR THE RATE OF INFLATION, THE SECURITY FUND DOES NOT PROVIDE THE SAME LEVEL OF PROTECTION TO THE PRODUCERS AS PROVIDED FOR BY SUBPARAGRAPH (I) OF THIS PARAGRAPH, THE COMMISSIONER SHALL CONTINUE THE COLLECTION OF SECURITY FUND FEES FOR SUCH YEAR. § 2.
