BILL NUMBER: S8256 SPONSOR: SUTTON TITLE OF BILL: An act to amend the administrative code of the city of New York, in relation to prohibiting the issuance of tickets to residential occupants for certain violations of the sanitation code PURPOSE OR GENERAL IDEA OF BILL: Residents of New York City should have the ability to leave town Friday afternoon without carrying the burden of being ticketed for putting trash out too early. Additionally, this legislation would allow for Sabbath-observant members of the Jewish community to comply with city rules without choosing between violating their religious beliefs or getting a sanitation ticket, as they are not permitted to put trash out on Friday once the Sabbath begins. SUTTON -- read twice and ordered printed, and when printed to be committed to the Committee on Cities 1 AN ACT to amend the administrative code of the city of New York, in relation to prohibiting the issuance of tickets to residential occu- pants for certain violations of the sanitation code THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision c of section 16-120 of the administrative code of the city of New York is amended by adding a new paragraph 4 to read as follows: 4. NOTWITHSTANDING ANY PROVISION OF THIS SUBDIVISION OR ANY RULE OF THE DEPARTMENT RELATING TO COLLECTION TO THE CONTRARY, THE DEPARTMENT SHALL NOT ISSUE A NOTICE OF VIOLATION, APPEARANCE TICKET OR SUMMONS TO ANY OWNER, LESSEE, TENANT OR OCCUPANT OF A RESIDENTIAL BUILDING OR DWELLING, NOR TO A PERSON WHO MANAGES OR CONTROLS SUCH A BUILDING OR DWELLING, FOR A VIOLATION OF PARAGRAPH (2) OF SUBDIVISION E OF THIS SECTION OCCURRING BETWEEN THE HOURS OF 3:00 P.M. ON FRIDAY AND 6:00 P.M. ON SATURDAY AS A RESULT OF PLACING REFUSE, SOLID WASTE OR RECYCLABLE MATERIAL OUT FOR COLLECTION EARLIER THAN ALLOWED UNDER THE RULES OF THE DEPARTMENT RELATING TO COLLECTION BY THE DEPARTMENT OR BY A PRIVATE CHARTER THAT IS REQUIRED TO BE LICENSED OR REGISTERED PURSUANT TO CHAP- TER 1 OF TITLE 16-A OF THE CODE. § 2.
