BILL NUMBER: S8379 SPONSOR: GIANARIS TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to an exemption for certain property from the prohibition of alcohol sales within a certain distance from a place of worship PURPOSE: To authorize the New York State Liquor Authority to issue an on-premise liquor license to Belo, a restaurant in Sunnyside, Queens. SUMMARY OF PROVISIONS: Section one of the bill amends subdivision 7 of section 64 of the alco- holic beverage control law by adding a new paragraph (e-17), which provides an exemption from the two-hundred-foot rule to the parcel described. Section two of the bill sets the effective date.

GIANARIS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the alcoholic beverage control law, in relation to an exemption for certain property from the prohibition of alcohol sales within a certain distance from a place of worship THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-17) to read as follows: (E-17) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDI- VISION, THE AUTHORITY MAY ISSUE A RETAIL LICENSE FOR ON-PREMISES CONSUMPTION FOR A PREMISES WHICH SHALL BE LOCATED WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED AS A CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP, PROVIDED SUCH PREMISES CONSTITUTE A PREMISES FOR THE SALE OF FOOD OR BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE COUNTY OF QUEENS, BOUNDED AND DESCRIBED AS FOLLOWS: ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND, SITUATE, LYING AND BEING IN THE BOROUGH AND COUNTY OF QUEENS, CITY AND STATE OF NEW YORK, BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE SOUTHERLY SIDE OF SKILLMAN AVENUE, DISTANT 44 FEET EASTERLY FROM THE CORNER FORMED BY THE INTERSECTION OF THE EAST- ERLY SIDE OF 48TH STREET, FORMERLY GROSMAN AVENUE, WITH THE SOUTHERLY SIDE OF SKILLMAN AVENUE; RUNNING THENCE SOUTHERLY AT RIGHT ANGLES TO SKILLMAN AVENUE AND PART OF THE DISTANCE THROUGH A PARTY WALL 74.20 FEET; THENCE EASTERLY PARALLEL WITH THE SOUTHERLY SIDE OF SKILLMAN AVENUE, 19 FEET; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
