Provides that in the case of any application for gas service to a building which is not supplied with gas, a utility corporation or municipality shall be obligated to provide gas service to such building.

 Introduced  by  Sen. KRUEGER -- read twice and ordered printed, and when
   printed to be committed to the Committee on Rules
 
 AN ACT to amend the public service law, in relation to the provision  of
   gas service to new customers
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Subdivision 4 of section 31 of the public service  law,  as
 added  by chapter 713 of the laws of 1981, is amended and a new subdivi-
 sion 4-a is added to read as follows:
   4. In the case of any application for ELECTRIC service to  a  building
 which  is  not supplied with electricity [or gas], a utility corporation
 or municipality shall be obligated to provide ELECTRIC service to such a
 building, provided however, that the commission may  require  applicants
 for service to buildings located in excess of one hundred feet from [gas
 or]  electric transmission lines to pay or agree in writing to pay mate-
 rial and installation costs relating to the  applicant's  proportion  of
 the pipe, conduit, duct or wire, or other facilities to be installed.
   4-A.  IN  THE  CASE  OF  ANY APPLICATION FOR GAS SERVICE TO A BUILDING
 WHICH IS NOT SUPPLIED WITH GAS, A UTILITY  CORPORATION  OR  MUNICIPALITY
 SHALL  BE  OBLIGATED  TO  PROVIDE GAS SERVICE TO SUCH BUILDING, PROVIDED
 HOWEVER, THAT THE COMMISSION SHALL REQUIRE APPLICANTS FOR GAS SERVICE TO
 SUCH BUILDING TO PAY OR AGREE IN WRITING TO PAY MATERIAL  AND  INSTALLA-
 TION  COSTS  RELATING TO THE PIPE OR OTHER FACILITIES TO BE INSTALLED TO
 ENABLE SERVICE TO THE APPLICANT.
   § 2. This act shall take effect immediately.
