BILL NUMBER: S8429 SPONSOR: FAHY TITLE OF BILL: An act to amend the mental hygiene law, in relation to authorizing hold- ers of certain operating certificates to employ or contract with applied behavior analysts and mental health counselors PURPOSE: To amend the mental hygiene law, in relation to authorizing holders of certain operating certificates to employ or contract with applied behav- ior analysts and mental health counselors. SUMMARY OF PROVISIONS: Section one of the bill adds a new subdivision (h) to section 16.03 of the mental hygiene law, authorizing entities that possess an operating certificate pursuant to Article 16 of the mental hygiene law to employ or contract with individuals operating within their scope of practice who are licensed or certified to practice applied behavioral analysis as

FAHY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the mental hygiene law, in relation to authorizing hold- ers of certain operating certificates to employ or contract with applied behavior analysts and mental health counselors THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 16.03 of the mental hygiene law is amended by adding a new subdivision (h) to read as follows: (H) ANY PROVIDER OF SERVICES THAT HOLDS AN OPERATING CERTIFICATE PURSUANT TO SUBDIVISION (A) OF THIS SECTION SHALL BE AUTHORIZED TO EMPLOY OR CONTRACT WITH PERSONS LICENSED OR CERTIFIED TO PRACTICE APPLIED BEHAVIOR ANALYSIS PURSUANT TO ARTICLE ONE HUNDRED SIXTY-SEVEN OF THE EDUCATION LAW AND WITH PERSONS LICENSED TO PROVIDE MENTAL HEALTH COUNSELING PURSUANT TO SECTION EIGHTY-FOUR HUNDRED TWO OF THE EDUCATION LAW. § 2.
