Requires fiscal notes to be included on any bill which imposes a new mandated insurance benefit or service; expands an existing mandated insurance benefit or service, or adds, expands or requires coverage of any benefit or service under the Medicaid fee-for-service program; requires such fiscal notes to include an actuarial analysis of the potential impact on insurance premiums as a result of such new or expanded mandated insurance benefit or service.

 AN ACT to amend the legislative law, in  relation  to  requiring  fiscal
   notes  for  bills imposing mandated benefits under insurance plans and
   under the Medicaid fee-for-service program

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The legislative law is amended by adding a new section 50-a
 to read as follows:
   § 50-A. FISCAL NOTE IN INSURANCE MANDATE BILLS. 1. A BILL WHICH ENACTS
 OR  AMENDS  ANY  PROVISION  OF LAW THAT IMPOSES A NEW MANDATED INSURANCE
 BENEFIT OR SERVICE, OR THAT EXPANDS AN EXISTING MANDATED INSURANCE BENE-
 FIT OR SERVICE, SHALL CONTAIN AN ACTUARIAL FISCAL NOTE STATING THE ESTI-
 MATED ANNUAL COST TO THE INSURANCE PREMIUM ON POLICYHOLDERS AFFECTED  BY
 SUCH ENACTMENT OR AMENDMENT AND THE SOURCE OF SUCH ACTUARIAL ESTIMATE.
   2.  THIS  SECTION  SHALL APPLY TO ALL BILLS THAT WILL IMPACT INSURANCE
 PLANS OF THE STATE OF NEW YORK OR OF ANY OF ITS  POLITICAL  SUBDIVISIONS
 AND  ALSO TO ALL BILLS THAT WILL IMPACT ANY INSURANCE PLAN OFFERED BY AN
 INSURER DOING BUSINESS IN THIS STATE AS AN AUTHORIZED INSURER.  FOR  THE
 PURPOSES  OF  THIS  SUBDIVISION,  "DOING  BUSINESS  IN  THIS STATE AS AN
 AUTHORIZED INSURER" SHALL HAVE THE SAME MEANING AS "DOING  AN  INSURANCE
 BUSINESS" AS DEFINED IN SECTION ELEVEN HUNDRED ONE OF THE INSURANCE LAW.
   3.  THE  FISCAL NOTE SHALL CONTAIN AN ACTUARIAL ANALYSIS OF THE POTEN-
 TIAL INSURANCE PREMIUM IMPACT OF IMPOSING SUCH  NEW  MANDATED  INSURANCE
 BENEFIT OR SERVICE OR EXPANDING SUCH EXISTING MANDATED INSURANCE BENEFIT
 OR  SERVICE,  AS  WELL  AS  AN  ANALYSIS  OF ITS POTENTIAL IMPACT ON ALL
 SEGMENTS OF THE INSURANCE MARKET.
   4. AN OMISSION OF SUCH FISCAL NOTE SHALL INVALIDATE SUCH BILL.
   § 2. The legislative law is amended by adding a new  section  50-b  to
 read as follows:
