TITLE OF BILL:

An act to amend the general business law, in relation to restricting
youth sports operators and youth sports facilities from prohibiting
parents and guardians from taking in-person recordings or photographs of
their children

 
PURPOSE:

To protect the right of parents and guardians to take in-person photo-
graphs and video recordings of their own children at youth sports
events, while allowing reasonable, safety-based restrictions.

 
SUMMARY OF PROVISIONS:

This bill amends the General Business Law by adding a new Article 41-A
governing youth sports facilities and youth sports operators. The bill
prohibits such facilities and operators from banning or restricting
parents or guardians from taking in-person photographs or video

recordings of their own children during youth sports events.

Specifically, the bill prevents facilities and operators from requiring
parents to purchase photography or video services as a condition of
recording their child, conditioning a child's participation or a
parent's admission on waiving recording rights, or confiscating or disa-
bling personal recording devices. The bill allows reasonable, content-
neutral restrictions narrowly tailored to safety, preventing interfer-
ence with play, compliance with court orders or privacy laws, or
limiting access to restricted areas.

The bill also requires facilities and operators to post clear notice of
these rights and renders unenforceable any contract, waiver, or policy
that attempts to waive or restrict a parent's ability to record their
own child. The bill does not prohibit facilities from offering photogra-
phy or video services for sale, provided those services are not used to
limit parental rights.

 
JUSTIFICATION:

Parents and guardians routinely attend youth sports events to support
their children and to document important moments in their development.
In recent years, some youth sports facilities and operators have adopted
policies that prohibit or restrict parents from taking in-person photos
or videos of their own children, or that require parents to purchase
exclusive recording services to access footage.

These practices can be confusing, burdensome, and unfair to families.
They may also limit parents' ability to share memories, monitor their
child's experience, or maintain personal records of participation.  This
bill establishes a clear, statewide baseline that protects parental
rights while preserving the ability of facilities and operators to
impose reasonable safety-based rules.

By making these protections explicit and uniform, the bill provides
clarity for parents, facilities, and operators alike, and ensures that

families are not forced to surrender basic rights as a condition of
participation in youth sports.

 AN ACT to amend the general business law,  in  relation  to  restricting
   youth  sports  operators  and youth sports facilities from prohibiting

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The general business law is amended by adding a new article
 41-A to read as follows:
                               ARTICLE 41-A
                               YOUTH SPORTS
 SECTION 1050. DEFINITIONS.
         1051. YOUTH   SPORTS   IN-PERSON   RECORDING   AND   PHOTOGRAPHY
                 RESTRICTIONS.
   § 1050. DEFINITIONS. AS USED IN THIS ARTICLE:
   1.  "YOUTH  SPORTS  FACILITY" MEANS ANY INDOOR OR OUTDOOR VENUE IN THE
 STATE OF NEW YORK THAT  HOSTS  ATHLETIC  EVENTS  INVOLVING  PARTICIPANTS
 UNDER THE AGE OF EIGHTEEN;
   2.  "YOUTH  SPORTS OPERATOR" MEANS ANY ENTITY THAT ORGANIZES, MANAGES,
 OR RUNS A YOUTH SPORTS EVENT AT A YOUTH SPORTS FACILITY; AND
   3. "IN-PERSON RECORDING OR PHOTOGRAPHY" MEANS VIDEO OR STILL PHOTOGRA-
 PHY CAPTURED BY A PARENT OR GUARDIAN FROM A PHYSICAL LOCATION INSIDE THE
 YOUTH SPORTS FACILITY USING PERSONAL DEVICES.  "IN-PERSON  RECORDING  OR
 PHOTOGRAPHY"  SHALL  NOT INCLUDE LIVESTREAMING, BROADCASTING, OR PROFES-
 SIONAL-GRADE FILMING.
   § 1051. YOUTH SPORTS IN-PERSON RECORDING AND PHOTOGRAPHY RESTRICTIONS.
 1. YOUTH SPORTS FACILITIES AND YOUTH SPORTS OPERATORS SHALL NOT:
   (A) PROHIBIT OR RESTRICT A PARENT OR GUARDIAN  FROM  TAKING  IN-PERSON
 VIDEO RECORDINGS OR PHOTOGRAPHS OF THEIR OWN CHILD;
   (B) ESTABLISH ANY REQUIREMENT THAT A PARENT OR GUARDIAN PURCHASE VIDEO
 SERVICES  OR  PHOTOGRAPHY,  SUBSCRIPTIONS, OR OTHER FORMS OF ACCESS AS A
 CONDITION OF TAKING THEIR OWN IN-PERSON RECORDINGS OR PHOTOGRAPHS;
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

   (C) CONDITION A CHILD'S PARTICIPATION,  OR  A  PARENT'S  ADMISSION  OR

 TAKE IN-PERSON RECORDINGS OR PHOTOGRAPHS; OR
   (D)  CONFISCATE,  DISABLE,  OR  OTHERWISE RESTRICT A PARENT'S PERSONAL
 DEVICE USED FOR IN-PERSON RECORDING OR PHOTOGRAPHY.
   2. YOUTH SPORTS FACILITIES  AND  YOUTH  SPORTS  OPERATORS  MAY  IMPOSE
 REASONABLE, CONTENT-NEUTRAL, NARROWLY TAILORED RESTRICTIONS ON IN-PERSON
 RECORDING  OR  PHOTOGRAPHY. SUCH RESTRICTIONS SHALL ONLY BE IMPOSED FOR:
 SAFETY, PREVENTING INTERFERENCE WITH PLAY OR OBSTRUCTION OF  SIGHTLINES;
 COMPLIANCE  WITH  COURT  ORDERS  OR  STATUTORY  PRIVACY  PROTECTIONS; OR
 RESTRICTING ACCESS TO AREAS WHERE SPECTATORS ARE NOT ORDINARILY ALLOWED.
 SUCH RESTRICTIONS SHALL BE WRITTEN, POSTED, AND APPLIED UNIFORMLY.
   3. YOUTH SPORTS FACILITIES AND YOUTH SPORTS  OPERATORS  SHALL  POST  A
 BRIEF  NOTICE  INFORMING  PARENTS  AND  GUARDIANS OF THEIR RIGHT TO TAKE
 IN-PERSON RECORDINGS AND PHOTOGRAPHS, SUBJECT  TO  THE  LIMITED  SAFETY-
 BASED  RESTRICTIONS  OF  THIS  ARTICLE. SUCH NOTICE SHALL ALSO APPEAR IN
 REGISTRATION MATERIALS OR CODES OF CONDUCT.
   4. ANY CONTRACT,  WAIVER,  REGISTRATION  FORM,  MEMBERSHIP  AGREEMENT,
 LEAGUE  RULE, OR FACILITY POLICY THAT RESTRICTS OR WAIVES THE ABILITY OF
 A PARENT OR GUARDIAN TO TAKE IN-PERSON VIDEO RECORDINGS  OR  PHOTOGRAPHS
 OF  THEIR  OWN  CHILD  SHALL BE VOID AND UNENFORCEABLE AS AGAINST PUBLIC
 POLICY.
   5. YOUTH SPORTS  FACILITIES  AND  YOUTH  SPORTS  OPERATORS  MAY  OFFER
 PHOTOGRAPHY  OR  VIDEO  SERVICES  FOR  SALE BUT SHALL BE PROHIBITED FROM
 USING SUCH SERVICES TO LIMIT, RESTRICT, OR INTERFERE WITH  A  PARENT  OR
 GUARDIAN'S  RIGHT  TO  TAKE IN-PERSON RECORDINGS OR PHOTOGRAPHS OF THEIR
 OWN CHILD.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have become a law.

PURPOSE:

To protect the ability of families and attendees to take personal photos
and videos at youth sports events, while maintaining reasonable, safe-
ty-based rules and transparency around commercial media services.

 
SUMMARY OF PROVISIONS:

This act adds a new Article 41-A to the General Business Law governing
youth sports organizations and youth sports facilities. It prohibits
organizations and facilities from banning, restricting, or penalizing
attendees for taking personal photos or videos at youth sports events
where spectators are permitted.

Organizations and facilities may not require the purchase of a photo or
video package as a condition of participation, entry, or attendance.
They are also barred from bundling media packages into registration or
other fees unless the cost is clearly and separately listed.

Where media packages are offered, organizations must clearly disclose
whether the package is optional, the full price, and the identity of the
vendor, including any relationship between the vendor and the organiza-
tion or facility.

Reasonable limits on recording are permitted in specific circumstances,
such as for safety, privacy, or in areas not open to the public. Any
such limits must be unrelated to commercial interests and must apply
equally to all attendees.  Organizations and facilities may continue to
enter into agreements with media companies to film or stream events, but
those agreements may not be used to prevent attendees from taking their
own photos or videos.

 
JUSTIFICATION:

Parents and families attend youth sports events to support their chil-
dren and to capture important moments. For many, these events are not
just games but milestones-first goals, final seasons, and shared experi-
ences that that families want to remember. The ability to take a photo
or short video from the stands has long been a normal and expected part
of that experience.

In recent years, some youth sports organizations and facilities have
adopted policies that restrict or discourage personal recording. In some
cases, families have been told they cannot take photos or videos at all.
In others, access to images or footage has been tied to the purchase of
a professional media package, sometimes bundled into registration or
event fees without clear notice. These practices can place families in a
position where they must pay to capture ordinary moments or risk penal-
ties for doing what has traditionally been allowed.

This act responds to those changes by establishing a clear baseline:
attendees at youth sports events may create personal media, and that
activity cannot be restricted or penalized for commercial reasons. At
the same time, it recognizes that youth sports settings require appro-
priate safeguards. Organizations and facilities may continue to enforce
reasonable rules to protect safety, preserve privacy, and maintain
order, including limits in non-public areas such as locker rooms.

The act also addresses the growing commercialization of youth sports
media. Photography and streaming services can provide value, but fami-
lies should not be required to purchase them or be misled about their
cost. By requiring clear disclosure of pricing, optionality, and vendor
relationships, the act ensures that families can make informed decisions
without hidden fees or pressure.

Importantly, the act preserves existing laws governing the use of a
minor's image and allows organizations to require parental consent for
official uses and to set reasonable rules for private or sensitive spac-
es. It also excludes school-based athletic programs and Olympic and
national governing body programs, where separate regulatory structures
already apply.

By setting clear, fair rules, this act preserves a common experience for
families, prevents coercive or unclear practices, and provides consist-
ency across youth sports programs in New York State.

 AN ATTENDEE AT A YOUTH SPORTS EVENT FROM A PHYSICAL LOCATION INSIDE  THE
 YOUTH SPORTS FACILITY USING A PERSONAL DEVICE.

 EXCEPT WHERE PERMISSIBLE PURSUANT TO SUBDIVISION THREE OF THIS SECTION;
   (B)  IMPOSE  OR ENFORCE A RULE INVOLVING A PENALTY BECAUSE AN ATTENDEE
 RECORDED ANY PORTION OF A YOUTH SPORTS EVENT, INCLUDING BUT NOT  LIMITED
 TO DISQUALIFICATION OR LOSS OF REGISTRATION PRIVILEGES;
   (C) REQUIRE THE SEPARATE PURCHASE OF A PROFESSIONAL MEDIA PACKAGE AS A
 CONDITION OF USAGE OF A YOUTH SPORTS FACILITY, PLAYER REGISTRATION, TEAM
 ENTRY, TEAM MEMBERSHIP, ENROLLMENT, OR SPECTATOR ADMISSION;
   (D)  BUNDLE  OR  EMBED  A PROFESSIONAL MEDIA PACKAGE INTO REGISTRATION
 FEES, TOURNAMENT FEES, MEMBERSHIP  FEES,  ADMISSION  CHARGES,  OR  OTHER
 SIMILAR  FEES OR PAYMENTS WITHOUT SEPARATELY, CLEARLY, AND CONSPICUOUSLY
 ITEMIZING THE COST OF THE PACKAGE AT THE TIME OF REGISTRATION; OR
   (E) MAINTAIN, OFFER, OR ENTER INTO, A WAIVER,  CONTRACT,  REGISTRATION
 FORM, AGREEMENT, RULE, OR POLICY THAT CONFLICTS WITH THE REQUIREMENTS OF
 THIS ARTICLE.
   2.  PRIOR  TO  REGISTRATION OR ENTRY FOR A YOUTH SPORTS EVENT, WHERE A
 PROFESSIONAL MEDIA PACKAGE IS MADE AVAILABLE TO ATTENDEES, YOUTH  SPORTS
 ORGANIZATIONS SHALL CONSPICUOUSLY DISCLOSE IN WRITING:
   (A) WHETHER THE PROFESSIONAL MEDIA PACKAGE IS OPTIONAL;
   (B)  THE  FULL  PRICE OF ANY OFFERED MEDIA SERVICES IN CONNECTION WITH
 THE PROFESSIONAL MEDIA PACKAGE; AND
   (C) THE IDENTITY OF THE PROFESSIONAL  MEDIA  PACKAGE  VENDOR  AND  ANY
 AFFILIATED  RELATIONSHIP BETWEEN SUCH VENDOR AND THE YOUTH SPORTS ORGAN-
 IZATION OR YOUTH SPORTS FACILITY.
   3. A YOUTH SPORTS ORGANIZATION OR YOUTH  SPORTS  FACILITY  MAY  IMPOSE
 RESTRICTIONS ON THE CAPTURING OF PERSONAL MEDIA WHERE:
   (A)  THE  YOUTH SPORTS ORGANIZATION HAS A DOCUMENTED SAFETY OR PRIVACY
 RATIONALE, UNRELATED TO COMMERCIAL INTEREST;
   (B) THERE ARE SPECIFIC ZONES, SUCH AS LOCKER ROOMS  OR  STAGING  AREAS
 WHERE THE GENERAL PUBLIC IS NOT PERMITTED; OR
   (C)  THERE IS A UNIFORM RESTRICTION ON ALL ATTENDEES, UNRELATED TO THE
 PURCHASE OF A PROFESSIONAL MEDIA PACKAGE.
   4. NOTHING IN THIS ARTICLE SHALL BE CONSTRUED AS PROHIBITING  A  YOUTH
 SPORTS  ORGANIZATION  OR YOUTH SPORTS FACILITY FROM ENTERING INTO EXCLU-
 SIVE ARRANGEMENTS WITH PROFESSIONAL MEDIA  VENDORS  FOR  THE  COMMERCIAL
 BROADCAST  OR  STREAMING  OF  YOUTH  SPORTS  EVENTS,  PROVIDED THAT SUCH
 ARRANGEMENTS DO NOT FORM THE BASIS FOR ANY PROHIBITION ON THE  CAPTURING
 OF PERSONAL MEDIA.
   5.  NOTHING IN THIS ARTICLE SHALL ALTER EXISTING STATE OR FEDERAL LAWS
 GOVERNING THE COMMERCIAL USE OF  A  MINOR'S  IMAGE  OR  LIKENESS.  YOUTH
 SPORTS  ORGANIZATIONS  MAY  CONTINUE TO REQUIRE PARENTAL CONSENT FOR THE
 PUBLICATION OF A MINOR ATHLETE'S PHOTOGRAPH OR VIDEO  IN  ORGANIZATIONAL
 MEDIA,  WEBSITES,  OR PROMOTIONAL MATERIALS, ESTABLISH REASONABLE SOCIAL
 MEDIA POLICIES GOVERNING  THE  POSTING  OF  ATHLETES'  IMAGES  BY  THIRD
 PARTIES  OR  ENFORCE  PROHIBITIONS ON THE RECORDING OF MINORS IN PRIVATE
 AREAS.
   6. THIS ARTICLE SHALL NOT APPLY TO:
   (A) INTERSCHOLASTIC ATHLETIC PROGRAMS ORGANIZED, OPERATED, OR GOVERNED
 BY A PUBLIC OR PRIVATE ELEMENTARY OR SECONDARY SCHOOL, SCHOOL  DISTRICT,
 BOARD  OF COOPERATIVE EDUCATIONAL SERVICES OR STATE ATHLETIC ASSOCIATION
 GOVERNING SCHOOL-BASED SPORTS; OR

   (B) ATHLETIC PROGRAMS ORGANIZED OR SANCTIONED  BY  THE  UNITED  STATES
 OLYMPIC  AND  PARALYMPIC COMMITTEE OR ANY NATIONAL GOVERNING BODY DESIG-
 NATED UNDER THE TED STEVENS OLYMPIC AND AMATEUR SPORTS ACT, 36 U.S.C.  §
 220501.
   7.  ANY PERSON WHO HAS BEEN INJURED BY REASON OF ANY VIOLATION OF THIS
 ARTICLE MAY BRING AN ACTION IN THEIR OWN NAME TO  ENJOIN  SUCH  UNLAWFUL
 ACT  OR  PRACTICE,  AN ACTION TO RECOVER SUCH PERSON'S ACTUAL DAMAGES OR
 TWO HUNDRED DOLLARS,  WHICHEVER  IS  GREATER.  THE  COURT  MAY,  AT  ITS
 DISCRETION,  INCREASE  THE  AWARD  OF DAMAGES TO AN AMOUNT NOT TO EXCEED
 THREE TIMES THE ACTUAL DAMAGES IF THE COURT FINDS THE DEFENDANT WILLFUL-
 LY OR KNOWINGLY VIOLATED THIS SECTION. THE COURT  MAY  AWARD  REASONABLE
 ATTORNEY FEES TO A PREVAILING PLAINTIFF.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
