 Introduced  by Sen. SCARCELLA-SPANTON -- read twice and ordered printed,
   and when printed to be committed to the Committee on Rules
 
 AN ACT to amend the labor law, in relation to requiring contractors  and
   subcontractors  performing  construction  work  for  covered renewable
   energy systems to have apprenticeship agreements; and to amend a chap-
   ter of the laws of 2025, amending the labor law relating to  requiring
   contractors   and  subcontractors  performing  construction  work  for
   covered renewable energy systems to use apprenticeship agreements,  as
   proposed  in  legislative  bills  numbers  S. 4881-A and A. 2730-A, in
   relation to the effectiveness thereof
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 8 of section 224-d of the labor law, as amended
 by  a  chapter  of  the  laws of 2025 amending the labor law relating to
 requiring contractors and subcontractors  performing  construction  work
 for  covered  renewable energy systems to use apprenticeship agreements,
 as proposed in legislative bills numbers S. 4881-A  and  A.  2730-A,  is
 amended to read as follows:
   8. A covered renewable energy system shall require all contractors and
 subcontractors performing construction work to [use] HAVE apprenticeship
 agreements,  as defined by article twenty-three of this chapter, and any
 thermal energy  network  covered  by  this  section  shall  additionally
 require  such  contractors  and  subcontractors to [use] HAVE AGREEMENTS
 WITH pre-apprenticeship  direct  entry  providers  registered  with  the
 department.
   § 2. Section 2 of a chapter of the laws of 2025 amending the labor law
 relating   to   requiring   contractors  and  subcontractors  performing
 construction work for covered renewable energy systems  to  use  appren-
 ticeship agreements, as proposed in legislative bills numbers S.  4881-A
 and A. 2730-A, is amended to read as follows:
   §  2.  This  act shall take effect [immediately] SEPTEMBER 1, 2026 AND
 SHALL APPLY TO ANY COVERED RENEWABLE ENERGY SYSTEM  AWARDED  A  CONTRACT
 PURSUANT  TO AN ADVERTISEMENT OR SOLICITATION OF A REQUEST FOR PROPOSAL,
 INVITATION FOR BID, OR SOLICITATION OF PROPOSAL,  OR  ANY  OTHER  METHOD
