 AN ACT to amend the state finance law, in relation to interest earned on
   the statewide opioid settlement agreement money
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Subdivision 4 of section 99-nn of the state finance law, as
 amended by chapter 171 of the laws  of  2022,  is  amended  to  read  as
 follows:
   4. Notwithstanding subdivision eleven of section four of this chapter,
 such  fund  shall consist of money received by the state pursuant to any
 statewide opioid settlement agreements, INCLUDING ANY INTEREST EARNED ON
 SUCH MONEY, as defined in section 25.18 of the mental hygiene  law.  All
 moneys shall remain in such fund unless and until directed by statute or
 appropriation.
   § 2. This act shall take effect immediately.

 RECEIVES  FUNDS  PURSUANT  TO  ANY STATEWIDE OPIOID SETTLEMENT AGREEMENT
 SHALL ENSURE THAT ANY INTEREST EARNED  ON  OPIOID  SETTLEMENT  FUNDS  BE
 SPENT  ON  APPROVED USES, AS SUCH TERM IS DEFINED IN AND CONSISTENT WITH
 THE PROVISIONS OF THE RESPECTIVE OPIOID  SETTLEMENT  AGREEMENT  AND  ITS
 EXHIBITS,  AND  SHALL ENSURE THAT SUCH SPENDING ON APPROVED USES IS DONE
 IN THE SAME MANNER AS SUCH SUBDIVISION DISTRIBUTES OTHER OPIOID  SETTLE-
 MENT FUNDS THAT ARE REQUIRED TO BE SPENT FOR APPROVED USES.
   § 2. This act shall take effect immediately.
