AN ACT to amend the public housing law, in relation to priority appli-
cants and inspection of units under the housing access voucher pilot
program
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 3 of section 608 of the public housing law, as
added by section 1 of part HH of chapter 56 of the laws of 2025, is
amended to read as follows:
3. Priority shall be given BOTH to applicants who are homeless AND TO
APPLICANTS WHO ARE AT RISK OF LOSING THEIR FEDERAL RENTAL SUBSIDY DUE TO
THE IMMINENT TERMINATION, REDUCTION OF FUNDING, OR CHANGES IN ELIGIBIL-
ITY IN FEDERAL LAW OR POLICY OF THE FEDERAL PROGRAM THAT PROVIDES SUCH
RENTAL SUBSIDY. The commissioner shall have the discretion to establish
further priorities as appropriate.
§ 2. Section 613 of the public housing law, as added by section 1 of
part HH of chapter 56 of the laws of 2025, is amended to read as
follows:
§ 613. Inspection of units. [Inspection of] HOUSING ACCESS VOUCHER
LOCAL ADMINISTRATORS SHALL INSPECT units [shall be conducted pursuant to
the procedures and standards of the Federal Housing Choice voucher
program, as set forth in the applicable sections of Part 982 of Title 24
of the Code of Federal Regulations] FOR WHICH A HOUSING ASSISTANCE
PAYMENT CONTRACT IS ESTABLISHED UNDER THIS ARTICLE, EXCEPT AS PROVIDED
IN SECTION SIX HUNDRED SIXTEEN OF THIS ARTICLE.
§ 3. This act shall take effect immediately; provided, however, that
the amendments to sections 608 and 613 of the public housing law made by
sections one and two of this act shall not affect the expiration of such
sections and shall expire therewith.
