Statement from Senator George Borrello on Second Circuit Decision Upholding New York’s Ammunition Background Check Law

“I strongly disagree with the Second Circuit Court of Appeals' decision to uphold New York’s ammunition background check law. This law is a clear violation of the Second Amendment rights of law-abiding citizens. It does nothing to make our communities safer and instead places unnecessary burdens on responsible gun owners who follow the law.
We continue to see criminals obtaining firearms and ammunition unfettered by any of New York’s oppressive gun laws. Meanwhile, the state’s focus on overregulating honest citizens does nothing to stop the real problem of illegal guns in the hands of violent offenders, a problem they’ve made worse with their disastrous criminal justice ‘reforms’ like cashless bail that have created revolving door justice for career criminals.
In my district, law-abiding sportsmen and gun owners routinely cross the border into Pennsylvania to buy ammunition because of this law’s intrusive requirements. The result is not greater safety, but fewer sales for local, taxpaying small businesses, all to appease an anti-Second Amendment agenda driven by the left.
New York’s leadership continues to ignore both common sense and constitutional principles. I will continue to stand with responsible gun owners and fight to restore their rights and end these politically motivated attacks on our freedoms.”
