Statement From Senator Liz Krueger And Assemblymember Linda Rosenthal On Governor's Veto Of New York Health Information Privacy Act

New York City – Senator Liz Krueger and Assemblymember Linda Rosenthal issued the following statement in response to Governor Kathy Hochul's veto of S.929/A.2141, the New York Health Information Privacy Act:

“At a time when Americans’ privacy rights are under fierce attack, Governor Hochul has put the interests of Big Tech over protecting regular New Yorkers. Most of us think our healthcare data is our own, that's it's protected by federal HIPAA laws and is sacrosanct, but that could not be further from the truth. Our health data is being collected, tracked, and sold to third parties by the very companies that are supposed to be taking care of us - including women's health apps.

"This bill passed the Legislature almost a year ago, leaving plenty of time for good-faith negotiations on chapter amendments. Unfortunately, despite our repeated requests for engagement, that time was not used until the very last weeks of the year. Now, instead of empowering New Yorkers by giving them control over how their health data is used, the Governor has chosen to allow these companies to keep monetizing our most intimate information to boost their profits.”

BACKGROUND:

The New York Health Information Privacy Act would help to protect health data privacy by governing companies that collect and sell healthcare information, and by creating a legal framework for residents to reclaim and retain control of their healthcare information. The bill requires electronic apps or websites that are designed to provide a diagnosis or retain health information to obtain affirmative consent from the user to retain such information, as well as separate consent to sell such information to third parties. This bill also bans the practice of using geolocation at healthcare facilities to send targeted advertisements to users while they are at the health care facility or shortly afterwards.
