The following bills were approved in the NYS Senate. Senator Gallivan's vote is noted for each bill.
S114 Prohibits state chartered banking institutions from investing in and providing financing for private prisons. NAY (Prohibits state chartered banking institutions from investing in and providing financing for private prisons.)
S5340C Allows medical assistants to administer vaccines while under appropriate supervision of a physician, nurse practitioner or physician assistant. NAY (Arbitrary new language.)
S2224B This bill increases the threshold for which 501(c)3 non-profit entities must file and register as a lobbyist from $5,000 to $10,000. B PRINT - Makes technical amendments. NAY (Decreases transparency.)
S2708A Relates to advancing grid enhancement technologies; allows the department of public service to approve requests from distribution companies to develop grid enhancement technologies; requires distribution companies to submit a compliance filing report every 5 years. A PRINT - This version has changed to a mandate that will force every utility to conduct this analysis. NAY (Increases costs to ratepayers.)
S3147 This bill would amend section 1101 of the Insurance Law, definitions regarding doing an insurance business, to remove non-indemnity prepaid legal service plans from the insurance law and thus insurance regulation, while maintaining regulations of traditional legal service insurance policies. AYE
S5280A This bill would require municipalities participating in Senior Citizen Rent Increase Exemption (SCRIE) and Disability Rent Increase Exemption (DRIE) programs to provide language access services. AYE
S5598A Enacts protections for private education loan borrowers and cosigners; requires certain notifications from creditors and debt collectors; prohibits acceleration; enacts provisions for cosigner release. AYE
S4188B Establishes the crime of misappropriation of payroll funds when a person knows that funds are designated for use as employee payroll funds or as payment of payroll taxes, and intentionally prevents the funds from being used for their designated purpose. AYE
S2078 Permits the Commissioner of Labor to direct the relevant agency to suspend or deny to an employer convicted of wage theft a license to do business in the state for up to two years, and to provide courts with a mechanism to ensure that ongoing wage theft does not occur while a charge of wage theft is pending prosecution. NAY (Overreach. Gives power to DOL to regulate other agencies with jurisdiction.)
S1116 Designates April twentieth as a day of commemoration to be known as New York State Constitution Day. AYE
S2546 Authorizes the mortgagee or lienor of an abandoned multiple dwelling to apply for the appointment of a receiver to bring the building into compliance. NAY (Adds costs of doing business.)
S9963 GOVERNOR'S PROGRAM BILL - Provides for emergency appropriation through April 22, 2026 for the support of government. AYE
S1714 Precludes the term excited delirium as a diagnosis, label, cause of death or contributing factor to a death from being cited on a death certificate. Also prohibits any law enforcement officer or peace officer from citing such term in a report or any autopsy or other examination to cite excited delirium as a cause or means or manner of death. NAY (Determination should be made by medical professionals.)
S4046 Prohibits fuel oil, grade number four in any building or facility in the state after July 1, 2030. NAY (Does not apply to NYC. Excessive cost of conversion.)
S3581 This bill would establish a new public health law section 1114-c regarding lead service line identification. AYE
S926 Regulates private arbitration organizations that administer consumer arbitrations in New York State by imposing public disclosure requirements and prohibiting certain financial conflicts of interest. NAY (Broad disclosure requirements undermine a core feature of arbitration, confidentiality.)
S4773 Prevents an agency, department, division, commission, bureau or any other entity under the authority of the executive department from contracting, subcontracting or hiring any third party during a hiring freeze. AYE
S1574A Establishes the electric landscaping equipment rebate program to reduce greenhouse gas emissions, improve air quality, and reduce noise pollution by promoting the adoption of quieter, zero emission landscaping equipment; provides for rebates at the point of sale for applicants purchasing or leasing certain equipment; provides for the repeal of such provisions upon expiration thereof. Adds snow removal equipment to the list as well as and directs NYSERDA to consult with businesses. NAY (Concerns from commercial landscapers. Additional costs for others.)
S1833A Enacts the "harmful algal bloom monitoring and prevention act"; establishes the harmful algal bloom monitoring and prevention fund. DEC would need to publish and update a list of vetted practice strategies for harmful algal bloom monitoring and prevention. AYE
S3835 Establishes the manufactured home community preservation act to provide financial and technical assistance, within funds available to counties, municipalities, rural preservation companies, and other non-profit housing organizations for their housing preservation efforts; provides that funds in the mortgage insurance fund can be used to provide financial support to local governments and eligible non-profit housing organizations. NAY (Limits property rights.)
S6765A Extends the Mercury Thermostat Collection Act, set to expire January 1, 2027 and provide that each manufacturer or collective organization shall submit a collection program plan, with specific requirements. AYE
S1055 Prohibits the division of criminal justice services from disclosing pending orders of adjournment in contemplation of dismissal on civil records of arrests and prosecutions. NAY
S1668 Authorizes NYSERDA to administer a program to provide grants or loans for the costs related to enabling switching residences with propane or fuel oil heating systems to efficient electric heat pumps. AYE
S5111A Enacts the "just energy transition act"; requires a study of competitive options to facilitate the phaseout, replacement and redevelopment of New York state's oldest and most-polluting fossil fueled generation facilities and their sites by the year 2030. NAY
S1463A Establishes extended producer responsibility for mattresses; requires mattress producers to establish a plan for the convenient and cost-effective recycling of used mattresses. Adds the definition for the word "new". NAY (Civil penalty unnecessary. Significant costs to State.)
S2057B Enacts the "beauty justice act"; provides for the regulation of ingredients in personal care products and cosmetics; prohibits the sale of personal care products and cosmetic products containing certain restricted products. NAY
S7809A Requires all state agencies to establish a composting program in buildings owned, occupied or operated by such agencies; allows such agencies to arrange for collection of compostable waste by a private carter, transport such waste itself or process such waste on-site; requires reports on the costs and effectiveness of such programs. NAY (Could be significant cost - proposal without appropriation.)
S9268A Prohibits the sale and distribution of anti-fogging sprays or wipes containing perfluoroalkyl and polyfluoroalkyl substances (PFAs); provides penalties for violations. AYE
S9598 GOVERNOR'S PROGRAM BILL - Requires the administration of certain vaccines for children in accordance with regulations issued by the commissioner, utilizing generally accepted medical standards and based on recommendations of the American Academy of Pediatrics, the American Academy of Family Physicians, the American College of Obstetricians and Gynecologists, the American College of Physicians, the Advisory Committee on Immunization Practices, and/or other similar nationally or internationally recognized scientific organizations. NAY (Arbitrary new language. Not necessarily based on science.)
S6570A Enacts the accelerate solar for affordable power (ASAP) act to set a new target for distributed solar energy capacity and direct the public service commission to advance reforms to the utility interconnection process to ensure timely and cost effective integration of new distributed energy resources. NAY (Investments mandated by this legislation would likely be put on the backs of ratepayers.)
S8512B Establishes the "Solar Up Now NY Act". Defines "portable solar generation device"; exempts portable solar generation devices from interconnection or net metering requirements; requires the state energy conservation construction code to allow for portable solar generation devices to be connected to a building's wiring through an electrical outlet. AYE
