The following bills were approved in the NYS Senate. Senator Gallivan's vote is noted for each bill.
S3852B Prohibits the sale of playground surfacing materials that contain PFAS, PAHs or more than ninety parts per million of lead on and after January 1, 2027; requires manufacturers of such playground surfacing materials to provide notice of such fact to distributors and retailers; provides penalties for violations. AYE
S3736 This bill would amend the project applications and advisory opinions of the public authorities control board. AYE
S119 Requires that any limited liability company who files a rent registration statement shall include a list of all members of such limited liability company and each member's ownership interest. NAY (Unnecessary regulation that limits privacy.)
S566 Permits enrollment in the address confidentiality program for election officers. NOTE - Election officer is defined under the election law as any person who performs any official duty or function in the electoral process. AYE
S630 Requires the district attorney to notify victims by letter of the final disposition of the case within sixty days of such disposition in cases where such final disposition includes a conviction; provides such letter shall also notify victims of their right to make a victim impact statement; allows them to personally appear at parole hearings and make such a statement. AYE
S3699 This bill would establish a task force to study the regulatory approach to the development of facial recognition technology. AYE
S1052 Directs the department of economic development to move the central New York welcome center to the equal rights heritage center in the city of Auburn; directs the department of economic development to enter into a contract with the city of Auburn for the operation of such welcome center. AYE
S5843 Requires electronic filing of all lobbying filings with the commission on ethics and lobbying in government. AYE
S257 Authorizes a study on lithium-ion battery fires and prevention to review the severity of lithium-ion battery fires, including what specific components of the battery causes severe fires; examine the effectiveness of lithium fireproof blankets on such fires; examine the current measures of safety implemented by fire departments across New York in relation to lithium-ion battery fires; requires a report to the governor and the legislature; makes related provisions. AYE
S5779 Requires school districts, public libraries, BOCES, county vocational education and extension boards, charter schools, and non-public elementary and secondary schools to provide and maintain on-site, opioid antagonists, including, but not limited to, naloxone nasal sprays, located with or adjacent to every AED. AYE (Benefit exceeds cost.)
S410 Provides that the court shall not reduce jury awards as excessive in employment discrimination actions unless the court finds exceptional circumstances which compel the conclusion that the jury was influenced by partiality, prejudice, mistake or corruption. NAY (Could significantly impede courts from stepping in and modifying awards where juries give excessive or unreasonable awards.)
S2627A Establishes the homeowner protection program; provides that the department of law shall establish the homeowner protection program to ensure the availability of free housing counseling and legal services to homeowners for the purposes of mitigating threats to homeownership; provides that the department of law shall provide grants to eligible not-for-profit housing counseling organizations and legal services organizations to provide services under the program. AYE
S661 Prohibits insurance companies from charging different rates for disability insurance on the basis of gender. AYE
S5116A Establishes the New York state Black history preservation commission to ensure the documentation and preservation of Black history in New York state within the state university of New York. AYE
S6600B Requires the inspection of non-fireproof buildings in a city having a population of one million or more every three years; requires compliance with the New York city housing maintenance code and the New York city construction codes; requires those dwellings not in compliance with such code at the time of inspection to make repairs or improvements necessary to comply with such standards within six months of such inspection, or a lien shall be placed upon the dwelling. NAY (Unrealistic time frames.)
S228A Requires manufactured home park owners to provide a written justification for rent increases in excess of three percent of the current rent; provides that increases in costs to justify such rent increase for ordinary maintenance or repair to meet the warranty of habitability obligations must be shown to be necessary. NAY (Difference in bill from 2021 requires owner to justify rate increase above 3% and to demonstrate that the rent increase was no more than necessary to cover the actual and reasonable cost of the work performed.)
S3819A This bill increases penalties for landlords of multiple dwellings with more than ten units who are in violation of the uniform fire prevention and building code who have failed to comply with an order to remedy. Under this legislation a property owner would have at most 14 days to remedy the problem before incurring fines. NAY
S4514A Requires the commissioner of labor to prepare an annual report on the cost of living, poverty rates and adequacy of the current minimum wage in the state. AYE
S879A Precludes local governments from regulating home vegetable, native plant or pollinator gardens except that it does not limit local governments from adopting general ordinances that do not specifically regulate such gardens. NAY (Takes away local control.)
S5265 Requires the Department of Corrections and Community Supervision (DOCCS) to cooperate with an authorized agency of a local department of social services to screen incarcerated individuals, 30 days prior to release, for eligibility for SNAP benefits and to assist such individuals in applying for said benefits. NAY (Personal responsibility.)
S4482 Amends the election law to require subpoenas relating to election matters be served with a separate informational sheet summarizing the reason for each subpoena being issued and other related information. AYE
S1368 Creates a temporary state pesticide commission to study the effects of the application of pesticides in cities with a population of one million or more. AYE
S887A This bill prohibits a surrogate's court clerk or chief clerk from accepting filing papers with specific deficiencies including the following: 1) paper does not have a filing number; 2) petition or decree contains the words "et al" or does not contain a full caption; 3) paper to be filed with the clerk is being filed in the wrong court; 4) paper is not signed in accordance with the rules of the chief administrator. AYE
S5288 This bill amends Article 21 of the CPLR, which provides rules governing papers served or filed, to provide that every exhibit shall be clearly identified but no specific method of labeling shall be required. AYE
S7663A Authorizes the assessor of Nassau county to accept an application for retroactive real property tax exempt status from Al-Muneer Foundation, Inc. AYE
S553 Relates to observance of all religious holidays by institutions within the state university and the city university of New York, and includes the Asian Lunar New Year within the definition of such holidays. AYE
S6334 Expands the description of certain services which are not prohibited by statutes governing the practice of nursing, including direct support staff to nurses. AYE (Will address workforce shortages.)
S6759 Authorizes the application of topical fluoride varnish to a child's teeth by a parent or legal guardian provided that such application is done under the direction and supervision of a licensed practitioner. AYE
S6929A This bill creates licensure and oversights of dental laboratories, who manufacture and produce dentures, crowns, bridges, orthodontic appliances and other dental restorations. AYE

S3820B Requires health insurance policies include coverage for anesthesia for the entire duration of a procedure for which a licensed medical practitioner has issued an order for such anesthesia. AYE
S2289 Expands the Mitchell-Lama admissions preference for veterans to include veterans and surviving spouses from all eras of combat service, not just those who served during a time of war. AYE
S7048 This bill would require DOH and the Public Health and Health Planning Council (PHHPC) to oversee alterations in perinatal services provided by general hospitals within the state of New York. AYE
S4956 Designates services to be provided by a jail-based substance use disorder treatment, peer led recovery support services, and transition services program as essential medical care services. AYE
S947 Prohibits residential landlords from charging tenants with fees for the payment of rent through an automated clearing house or online payment system. AYE
S1142 Amends the Civil Practice Laws and Rules (CPLR) to extend the statute of limitations (SOL) from three to six years for individuals to file cases based on unlawful discriminatory practice in employment pursuant to the Human Rights Law. AYE
S5089 Creates a residential condominium owner's bill of rights that includes the right to transparency, the right to timely decisions, voting rights, the right to notice, and the right against extraordinary expenses. AYE
S903 This bill would expand the informal caregiver training program to include an individual providing care for a person in need of assistance or an older adult providing care to a minor relative in their home. AYE
S8941 Authorizes Farmingdale First Baptist Church, Inc. to receive retroactive real property tax exempt status with respect to the 2023, 2024, and 2025 assessment rolls. AYE
S7858 This bill seeks to restore to the Senate full and proper advice and consent power regarding nominations of chief executive officers of the NYS Dormitory, NYS Thruway Authority, New York Power Authority, and the Long Island Power Authority. AYE
S1610 Requires for construction activities that require a state pollutant discharge elimination system permit owners and operators to submit a copy of the required public notice; requires each county receiving such notice to make such notice publicly available on its website. AYE
S2411 This bill relates to bio-heating fuel requirements and allows B100 or B99 biofuel and R100 or R99 renewable fuel to be used to blend with or replace fossil heating oil in order to create bio-heating fuel. AYE
S6831A Requires the owner or operator of a major facility or a vessel to establish and maintain with the department evidence of financial responsibility sufficient to meet the amount of liability. AYE
S3207A This bill amends the public health law to establish a maximum contaminant level of 4 parts per trillion (ppt) for perfluorooctane sulfonic acid (PFOS) and perfluorooctanoic acid (PFOA) and 10 parts per trillion (ppt) for perfluorononanoic acid (PFNA), perfluorohexane sulfonate (PFHxS), hexafluoropropylene oxide dimer acid (HFPO-DA), and perfluorobutane sulfonate (PFBS) in drinking water supplies. AYE
S936A Directs state agencies to submit reports detailing their telework policies; permits input from employees anonymously; directs the department of civil service to compile reports and submit a single report to the legislature. AYE
S2437A Requires social media influencers to disclose when they share on social media that they are being paid by a campaign; authorizes the state board of elections to promulgate certain regulations. A PRINT - makes technical amendments. AYE
S919A Requires local boards and the division of housing and community renewal to submit certain residential housing and zoning information to the department of state annually; requires such information to be published by the department of state on its website. NAY
S2587 Establishes January 30th of each year as a day of commemoration known as "Fred Korematsu Day of Civil Liberties and the Constitution". AYE
S3204 Creates the offense of defrauding the government in the first degree (via the use of an automated sales suppression device to evade any tax owed to the state or a municipality) and expands the definition of conspiracy in the fourth degree; to include the aforementioned felony. Defrauding the government in the 1st degree is a class D felony and conspiracy in the 4th is a class E felony. AYE
S3180 Provides the director of the office for the aging to develop a program to train senior service providers in detecting and reporting elder abuse. AYE
S4805 Requires the state to handle all income verification necessary to receive the senior citizen tax exemption. Amends the Real Property Tax Law to allow income eligibility of applicants to be verified annually by the department, and the assessing authority will not need to request income documentation. AYE
S2084 Requires municipalities to determine whether it is in the public interest to create a comprehensive plan adapted to the special requirements of the municipality and to determine whether it is in the public interest to update such comprehensive plan at least once every ten years to ensure that such plan addresses housing needs. AYE
S2556 Ensures that when land is disposed of by public authorities, certain safeguards are in place, including disclosure of ownership information, ensuring that disposals with that contain rights of first refusal make certain that the land is transferred at or above fair market value, that when land is transferred for less than fair market value, it is in the public interest to do so and the legislature retains oversight. AYE
