The following bills were approved in the NYS Senate. Senator Gallivan's vote is noted for each bill.
S5982 Authorizes the department of environmental conservation to independently add to the lists of prohibited and regulated invasive species on an emergency basis pending review by the department of agriculture and markets in consultation with the New York invasive species council. AYE
S5600 The bill sets a cap on installment credit interest rates that is equal to the state usury rate of 16 percent. AYE
S1239F Enacts the "food safety and chemical disclosure act"; prohibits certain food additives and food color additives; provides that in an action to enforce compliance, the recognition by the federal food and drug administration of any of these substances as safe may not be alleged as a defense; establishes requirements for the reporting of GRAS (generally recognized as safe) substances. AYE
S4964 This bill amends section 2118 of the insurance law regarding excess line coverage, to remove the requirement that excess line brokers must obtain a declination from the medical malpractice insurance pool before the broker can place primary malpractice insurance in the excess line market. AYE
S2482 Enacts the "go green schools act" to assist school districts in converting to renewable energy sources as a primary source of energy; directs NYSERDA to conduct a study and make recommendations for such purpose. AYE
S1787 Provides that the "Suicide Awareness and Remembrance Flag" shall be the official state flag for the raising of awareness of veteran suicide; directs the commissioner of general services to establish a protocol for the flying of such flag. AYE
S2640 Includes veterans in the definition of military status to protect veterans from being unlawfully discriminated against. AYE
S2499 This bill would amend section 120 of the Workers' Compensation Law relating to discrimination against employees who have taken paid family leave. NAY (Private right of action)
S5183B This bill amends the election law to require the following additional statement on the back of the envelopes for ballots for early mail voters, absentee voters and special presidential voters: "IMPORTANT TO ABSENTEE VOTER: YOU MUST SIGN THE AFFIRMATION ON THIS ENVELOPE." AYE
S3231 This bill provides that a citizen who is 17 years old at the time of a primary election and who will be 18 years of age at the time of the general election(for which the primary is being held) shall be eligible to vote in such primary election. NAY (Unconstitutional.)
S1191 Provides for limited credit time allowances for working in the horse handling program for a period of no less than eighteen months and receipt of a certification from the Groom Elite program. NAY
S1816 Reduces “Elevated lead levels” to greater than or equal to 3.5 micrograms of lead per deciliter of whole blood in relation to the State’s Lead Poisoning Prevention Programs. AYE
S9388 This bill establishes the local input in community healthcare act. The bill includes provisions requiring written notification of a proposed closure of a general hospital or unit (a portion of a general hospital that offers emergency, maternity and mental health or substance use services or other hospital or health-related service of a hospital, if proposed closure would result in reduction or unavailability of services in the hospital’s service area or county where it is located) of a general hospital must be provided no later than 270 days prior to the proposed closure to the Department of Health (DOH) and the following parties: health care providers, labor unions, local, state and federal legislative representatives, the attorney general, the county executive, mayor, town supervisor and in NYC the borough president and community board for the district in which the hospital or unit is located. NAY (Public disclosure of a proposed closure goes too far and will hamper efforts to retain the existing workforce. Moreover, does not provide flexibility for rapidly changing or unforeseen circumstances.)
S1057 Provides that any municipality that has received alienation authorization through enactment of municipal parkland alienation legislation shall submit a report to the Office of Parks, Recreation and Historic Preservation. AYE
S7618A This bill establishes new food safety and quality date labelling requirements that must go into effect on July 1, 2028. AYE
S438A Establishes the prescription drug supply chain transparency act by establishing a new Article 30 in the insurance law. AYE
S3689 Amends real property actions and proceedings law to prohibit a tenant from being removed from a residential unit for the certified medical use of medical marihuana. AYE
S6718B Prohibits the imposition of any surcharge for the installation or use of a tenant-installed appliance where the tenant pays for electric utility service, under rent control, and rent stabilization laws in the City of New York. NAY (Additional rent control.)
S7731 Requires insurance coverage of a hospitalized birthing parent's interhospital transport to accompany such birthing parent's newborn infant experiencing a condition necessitating transport. AYE
S8542 Directs the department of health, in conjunction with other state agencies, to establish and maintain a directory webpage locating publicly accessible lactation accommodations in state-owned and state-leased buildings. AYE
S7821A Prohibits the sale of children's products, mattresses and upholstered furniture containing fiberglass unless they contain a prominent label; defines children's product; prohibits custom upholsterers from repairing or restoring any children's product, mattress or furniture with parts that contain fiberglass; provides remedies for violations. AYE
S4039A Amends the Public Officers Law to prohibit statewide elected official, state officer or employee, member of the legislature, legislative employee or political party chairman who owns or controls a certain percentage of a corporation or limited liability company from receiving compensation for consulting or legal services from a state or local authority. NAY (Public bidding should be open to all.)
S7681 Prohibits a state or local authority, or subsidiary thereof, from retaining, contracting, employing, or designating a lobbyist to engage in lobbying; allows for the cancellation of pre-existing contracts. AYE
S5067A Directs the commissioner of education to change the name of the state high school equivalency diploma, formerly known as the general education development (GED) program, to the Excelsior diploma. AYE
S6365 This bill requires any financial institution which enters into a contract with the state to issue "release debit cards" to inmates upon their release from prison to provide a clear, understandable, and detailed schedule of fees and charges with each card. AYE
S9183 Expands eligibility requirements for horses participating in the three racing levels of the New York Sire Stakes program. AYE
S1380A Requires the department of environmental conservation and the department of health to establish certain standards related to the cleaning of playground equipment after pesticide exposure. AYE
S5400 Exempts operators of law enforcement and fire department vessels from laws which regulate vessels on the navigable waters of the state while such operators are in the course of responding to emergencies. AYE
S3443 Designates March 25, "Medal of Honor Day", as a day of commemoration. AYE
S3758 This bill amends the General Business Law to expand and clarify protections for senior citizens and disabled individuals residing in buildings undergoing conversion to cooperative or condominium ownership. NAY (Infringes upon rights of property owners.)
S6475 Establishes a senior housing task force for the purposes of conducting a state-wide assessment of senior housing needs taking into consideration the various geographical areas and different needs of the seniors in those areas and resources available in those different areas. AYE
S6970 Requires the return of unsold instant lottery game tickets to the division of the lottery when a licensed agent goes out of business, sells their business or if their license is suspended or revoked. AYE (Protects the integrity of the lottery system.)
S8276 Allows a non-resident to hold the position of assistant county attorney in the county of Rockland. AYE
S70 Provides that any person who has been injured by reason of any violation of any such rules, regulations or policies as the superintendent may promulgate may bring an action in his or her own name; assert a counterclaim; or, if an action is commenced by the mortgagee or anyone acting on its behalf, bring a third party claim, against either the mortgagee and/or the mortgage servicer to enjoin any violations thereof; authorizes damages; makes related provisions. NAY (Would have an major impact on lenders who are seeking to enforce valid mortgages.)
S5177 This bill requires a notary appointed and commissioned in NYS and a commissioner of deeds to create a notarial record of each notarial act performed in connection with a document of conveyance, and file that record. NAY
S8357 OSC DEPARTMENTAL - Would authorize community banks and minority depository institutions with the option to use reciprocal deposits to secure federal deposit insurance for the value of the state's deposits as an alternative to collateral. AYE
S3518 Establishes the fentanyl abuse and overdose prevention task force to conduct a comprehensive study on fentanyl abuse and overdose prevention and to report on the findings and recommendations of the task force. AYE
S1670B Requires all major health insurance plans to cover outpatient "comprehensive lactation support services". This does not apply to Medicaid plans. AYE
S900 This bill would amend subdivision 3 of paragraph c of section 58 of the Local Finance Law to authorize local governments to collect good faith deposits only after determining the successful bidder of a bond offer instead of including them as an integral part of the bid for bonds. AYE
S7677A Permits the town of Warwick to utilize preservation funds for the implementation of water quality improvement projects. AYE
S413 Amends general obligations law to render unenforceable any claim settlement between an employer and an employee or independent contractor, who is a natural person, if such settlement prohibits the employee or contractor from working for the employer, or any entity related to the employer, in the future. NAY (Infringement on rights of employers. Opens door to retaliatory future claims by employees.)
