BILL NUMBER:S7472

TITLE OF BILL:
An act
to amend the mental hygiene law, in relation to requiring the
commissioner of mental health to define a career path for direct support
professionals

PURPOSE:
Amend mental hygiene law by adding a new section, 16.39 to create a
public workforce initiative to define a career path model for direct
support professionals.

SUMMARY OF PROVISIONS:
The commissioner, in conjunction with national and state experts,
shall create a public workforce initiative to define a career path
model for direct support professionals by blending best practice
learning initiatives including the University of Minnesota's College
of Direct Support and New York State Direct Support Competencies

JUSTIFICATION:
New York State's system of services for individuals with developmental
disabilities have changed dramatically over the past decades, to one
that was institution-based to one which today supports thousands of
individuals in their home communities. With that change has come an
equally significant need for learning seminars on the trends of
developmentally disabled services toward competency based training,
the role and value of skill mentors, and facilitating direct support
professional portfolio development.

EFFECTIVE DATE:

  printed to be committed to the Committee on Mental Health and Develop-
  mental Disabilities

AN ACT to amend the mental hygiene law, in  relation  to  requiring  the
  commissioner  of  mental  health  to  define  a career path for direct
  support professionals

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The mental hygiene law is amended by adding a new section
16.39 to read as follows:
  S 16.39 CAREER PATH FOR DIRECT SUPPORT PROFESSIONALS.  NOTWITHSTANDING
ANY GENERAL OR  SPECIAL  LAW  TO  THE  CONTRARY,  THE  COMMISSIONER,  IN
CONJUNCTION WITH NATIONAL AND STATE EXPERTS, SHALL CREATE A PUBLIC WORK-
FORCE  INITIATIVE  TO  DEFINE  A  CAREER  PATH  MODEL FOR DIRECT SUPPORT
PROFESSIONALS BY BLENDING BEST PRACTICE LEARNING  INITIATIVES  INCLUDING
THE  UNIVERSITY  OF  MINNESOTA'S  COLLEGE OF DIRECT SUPPORT AND NEW YORK
STATE DIRECT SUPPORT PROFESSIONAL COMPETENCIES. FOR  PROVIDER  ORGANIZA-
TIONS,  THE  DEPARTMENT SHALL CONDUCT ONE-DAY REGIONAL LEARNING SEMINARS
