BILL NUMBER:S4522 TITLE OF BILL: An act to amend the environmental conservation law, in relation to establishing a product stewardship program for primary batteries PURPOSE OR GENERAL IDEA OF BILL: The purpose of the bill is to require participation in a battery stewardship plan (recycling plan) by producers of primary batteries or primary battery-containing products. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill amends Article 27 of the environmental conservation law by adding a new title 16 that will mandate participation by producers of primary batteries or primary battery-containing products in a battery stewardship (recycling) plan. Section 27-1601 sets forth definition for all terms of this new title including the definition of primary battery which means a nonrechargeable battery weighing two kilograms or less, including alkaline, carbon-zinc, lithium-metal, and other batteries typically generated as waste. Section 27-1603 states that the beginning January 1, 2017 a producer of a primary battery or primary batter-containing product shall not sell, offer for sale, or deliver to a retailer for subsequent sale a
