 TITLE OF BILL :  An act to amend the education law, in relation to
establishing the community college funding study

 PURPOSE :

Requires a study to consider alternative funding for community
colleges.

 SUMMARY OF PROVISIONS :

Section 1. Adds new subdivision 14 to section 6304 of the education
law to provide that SUNY and CUNY trustees shall require each
community college president in each of the systems to establish an
internal committee directed to study the effectiveness of the current
full time equivalent (FTE) funding formula and alternatives.
Committees will consider funding of each academic program while taking
into account the specific mission, needs, geographic location and
uniqueness of such community college under review.

The new subdivision further provides that each internal committee
shall report recommendations to their university system's board of
trustees on December 1, 2017 and the board of trustees of each system
shall report recommendations to the Chairs of the Senate and Assembly
Higher Education Committees by January 1, 2018.

Section 2. Sets for the effective date.

 JUSTIFICATION :

During this year's discussions on community college funding, SUNY put
forth a "hold harmless" model for their community colleges because of
issues related to enrollment. Because community colleges are funded on
an FTE model, a school that loses significant enrollment will also
lose significant operating aid.

This year alone, SUNY was faced with a cut of over $10 million in
funding for community colleges because of decreasing enrollment. This
legislation will allow the individual schools and the university
systems as a whole, a chance to examine the issue and offer
recommendations.

 AN ACT to amend the education  law,  in  relation  to  establishing  the
   community college funding study
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 6304 of the education law is amended  by  adding  a
 new subdivision 14 to read as follows:
   14.  COMMUNITY COLLEGE FUNDING STUDY. A. THE STATE UNIVERSITY TRUSTEES
 AND THE CITY UNIVERSITY TRUSTEES SHALL REQUIRE  EACH  COMMUNITY  COLLEGE
 PRESIDENT  IN  EACH OF THEIR UNIVERSITY SYSTEMS TO ESTABLISH AN INTERNAL
 COMMITTEE THAT SHALL BE DIRECTED  TO  STUDY  THE  EFFECTIVENESS  OF  THE
 CURRENT  FULL  TIME  EQUIVALENT  (FTE)  FUNDING FORMULA AND ALTERNATIVES
 BASED ON FUNDING BY ACADEMIC PROGRAM THAT TAKES INTO ACCOUNT THE SPECIF-
 IC MISSION, NEEDS, GEOGRAPHIC LOCATION AND UNIQUENESS OF SUCH  COMMUNITY
 COLLEGE.
   B.  THE  INTERNAL COMMITTEE ESTABLISHED BY EACH SUCH COMMUNITY COLLEGE
 PRESIDENT SHALL CONSULT WITH THE BOARD OF TRUSTEES OF  THEIR  UNIVERSITY
 SYSTEM AND PROVIDE INFORMATION THAT MAY BE REQUESTED TO SUCH TRUSTEES TO
 AID  IN THE CREATION OF RECOMMENDATIONS REQUIRED PURSUANT TO THIS SUBDI-
 VISION, AND MAY CONSULT WITH  HIGHER  EDUCATION  PROFESSIONALS  AND  THE
 REGIONAL  STATE UNIVERSITY OF NEW YORK COMMUNITY COLLEGE COUNCIL IN SUCH
 REGION, IF APPLICABLE.
   C. EACH INTERNAL COMMITTEE SHALL CONSIDER:
   (I) THE EFFECT OF THE CURRENT FTE FUNDING MODEL ON OVERALL FUNDING FOR
 THE COMMUNITY COLLEGE AND ALTERNATIVES TO SUCH MODEL;
   (II) THE CREATION OF NEW ACADEMIC PROGRAMS THAT MAY BE  BENEFICIAL  IN
 SUPPORTING REGIONAL BUSINESS AND INDUSTRY WORKFORCE NEEDS;
   (III)  DUPLICATION  OF  ACADEMIC  DEGREE  PROGRAMS  IN  SUCH COMMUNITY
 COLLEGE'S REGION; AND
   (IV) ANY OTHER ISSUES THE INTERNAL COMMITTEE DEEMS NECESSARY.

report recommendations to the Chairs of the Senate and Assembly Higher
Education Committees by January 1, 2018.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   14. COMMUNITY COLLEGE FUNDING STUDY. A. (I) THE STATE UNIVERSITY TRUS-

 SITY SYSTEM TO ESTABLISH AN INTERNAL COMMITTEE THAT SHALL BE DIRECTED TO
 STUDY  THE EFFECTIVENESS OF THE CURRENT FULL TIME EQUIVALENT (FTE) FUND-
 ING FORMULA AND ALTERNATIVES BASED ON FUNDING BY ACADEMIC  PROGRAM  THAT
 TAKES  INTO ACCOUNT THE SPECIFIC MISSION, NEEDS, GEOGRAPHIC LOCATION AND
 UNIQUENESS OF SUCH COMMUNITY COLLEGE.
   (II) THE INTERNAL COMMITTEE ESTABLISHED BY EACH SUCH COMMUNITY COLLEGE
 PRESIDENT SHALL CONSULT WITH THE STATE UNIVERSITY BOARD OF TRUSTEES  AND
 PROVIDE INFORMATION THAT MAY BE REQUESTED TO SUCH TRUSTEES TO AID IN THE
 CREATION  OF  RECOMMENDATIONS REQUIRED PURSUANT TO THIS SUBDIVISION, AND
 MAY CONSULT WITH HIGHER EDUCATION PROFESSIONALS AND THE  REGIONAL  STATE
 UNIVERSITY  OF  NEW  YORK  COMMUNITY  COLLEGE COUNCIL IN SUCH REGION, IF

 CURRENT FULL TIME EQUIVALENT (FTE) FUNDING FORMULA IN USE AT ITS  COMMU-
 NITY COLLEGES AND ALTERNATIVES BASED ON FUNDING BY ACADEMIC PROGRAM. THE
 INTERNAL  COMMITTEE  SHALL  INCLUDE  REPRESENTATIVES  OF  THE  COMMUNITY
 COLLEGES.
   (II) THIS INTERNAL COMMITTEE SHALL CONSULT WITH  THE  CITY  UNIVERSITY
 BOARD  OF TRUSTEES AND PROVIDE INFORMATION THAT MAY BE REQUESTED BY SUCH
 TRUSTEES TO AID IN THE CREATION OF RECOMMENDATIONS REQUIRED PURSUANT  TO
 THIS SUBDIVISION, AND MAY CONSULT WITH HIGHER EDUCATION PROFESSIONALS.
   (III) THE INTERNAL COMMITTEE SHALL CONSIDER:
   (A) THE EFFECT OF THE CURRENT FTE FUNDING MODEL ON OVERALL FUNDING FOR

   (III) EACH INTERNAL COMMITTEE SHALL CONSIDER:

 CURRENT  FULL TIME EQUIVALENT (FTE) FUNDING FORMULA IN USE AT ITS COMMU-
 NITY COLLEGES AND ALTERNATIVES BASED ON FUNDING BY ACADEMIC PROGRAM. THE
 INTERNAL  COMMITTEE  SHALL  INCLUDE  REPRESENTATIVES  OF  THE  COMMUNITY
 COLLEGES.
   (II)  THIS  INTERNAL  COMMITTEE SHALL CONSULT WITH THE CITY UNIVERSITY
 BOARD OF TRUSTEES AND PROVIDE INFORMATION THAT MAY BE REQUESTED BY  SUCH
 TRUSTEES  TO AID IN THE CREATION OF RECOMMENDATIONS REQUIRED PURSUANT TO
 THIS SUBDIVISION,  AND  SHALL  CONSULT  WITH  REPRESENTATIVES  FROM  THE
 EMPLOYEE  COLLECTIVE BARGAINING ORGANIZATION THAT REPRESENTS FACULTY AND
 HIGHER EDUCATION PROFESSIONALS.
   (III) THE INTERNAL COMMITTEE SHALL CONSIDER:
   (A) THE EFFECT OF THE CURRENT FTE FUNDING MODEL ON OVERALL FUNDING FOR
 THE COMMUNITY COLLEGES AND ALTERNATIVES TO SUCH MODEL;
   (B) THE CREATION OF NEW ACADEMIC PROGRAMS THAT MAY  BE  BENEFICIAL  IN
 SUPPORTING LOCAL BUSINESSES AND INDUSTRY WORKFORCE NEEDS;
   (C) DUPLICATION OF ACADEMIC DEGREE PROGRAMS IN THE CITY; AND
   (D) ANY OTHER ISSUES THE INTERNAL COMMITTEE DEEMS NECESSARY.
   (IV)  THE  INTERNAL COMMITTEE SHALL REPORT RECOMMENDATIONS TO THE CITY
 UNIVERSITY'S BOARD OF TRUSTEES ON DECEMBER FIRST,  TWO  THOUSAND  SEVEN-
 TEEN, AND THE CITY UNIVERSITY BOARD OF TRUSTEES SHALL REPORT RECOMMENDA-
 TIONS  TO THE CHAIRS OF THE SENATE AND ASSEMBLY HIGHER EDUCATION COMMIT-
 TEES BY JANUARY FIRST, TWO THOUSAND  EIGHTEEN,  PROVIDED  HOWEVER,  THAT
 NOTHING IN THIS SECTION SHALL BE CONSTRUED TO  REQUIRE A CHANGE IN STATE
 SUPPORT.
   § 2. This act shall take effect immediately.
