TITLE OF BILL:  An act to amend the public authorities law, in
relation to the construction and financing of facilities by the dormito-
ry authority for the New York Alliance for Inclusion and Innovation; and
to amend chapter 371 of the laws of 1998, amending the public authori-
ties law relating to the construction and financing of facilities by the
dormitory authority for the New York State Rehabilitation Association,
in relation to extending the expiration and repeal of such provisions

 
PURPOSE OF BILL:

This bill would extend for an additional five years the authorization
for the New York State Rehabilitation Association, and its successor
organization upon the completion of a merger, to receive construction
management and financial services from the Dormitory Authority. The New
York State Rehabilitation Association's current authority expires on
December 31, 2018, and this legislation would extend it until December
31, 2023.

SUMMARY OF PROVISIONS OF BILL:

This bill would amend public authorities law and chapter 371 of the laws
of 1998 to change the effective date so that the New York State Rehabil-
itation Association, and its successor organization, the New York Alli-
ance for Inclusion and Innovation, continues to have authority to avail
itself of Dormitory Authority Construction and management financial
services for another five years.

 
JUSTIFICATION:

The New York State Rehabilitation Association is a private, not-for-pro-
fit statewide organization providing leadership and advocacy on multiple
matters of public policy on behalf of disabilities providers and the
individuals they serve; it informs, educates, and supports association
members in their effort to offer a diverse spectrum of services; and
helps integrate people with differing abilities into the community.Since
the New York State Rehabilitation Association's authority to utilize
Dormitory Authority construction and management services was estab-
lished, the New York State Rehabilitation Association has had the oppor-
tunity to offer bonds involving improvement projects and loans through-
out the state which yield a savings in public funds.

Expiration of the New York State Rehabilitation Association's authority
would harm significant bond initiatives underway, resulting in lost
savings to the state and lost funding to reinvest in critical supports
and services to people with disabilities. Future bond issues contingent
on this legislation are expected to continue to benefit the taxpayers of
New York and people served by New York State Rehabilitation Association,
and its successor association member agencies.

EFFECTIVE DATE:
This act shall take effect immediately, provided that the amendments to
the undesignated paragraph of paragraph (b) of subdivision 2 of section
1676 of the public authorities law, made by section one of this act, and
the amendments to the two undesignated paragraphs of subdivision 1 of
section 1680 of the public authorities law, made by section two of this
act, shall not affect the expiration and repeal of such undesignated
paragraphs pursuant to section 5 of chapter 371 of the laws of 1998, as
amended, and shall expire and be deemed repealed therewith.

 AN  ACT  to  amend  the  public  authorities  law,  in  relation  to the
   construction and financing of facilities by  the  dormitory  authority
   for  the  New York Alliance for Inclusion and Innovation; and to amend
   chapter 371 of the laws of 1998, amending the public  authorities  law
   relating to the construction and financing of facilities by the dormi-
   tory  authority  for the New York State Rehabilitation Association, in
   relation to extending the expiration and repeal of such provisions
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The undesignated paragraph of paragraph (b) of subdivision
 2 of section 1676 of the public authorities law, as amended  by  chapter
 580 of the laws of 2003, is amended to read as follows:
   Not-for-profit  members  of  the New York State Rehabilitation Associ-
 ation AND THE NEW YORK ALLIANCE FOR INCLUSION  AND  INNOVATION  AND  ANY
 SUCCESSOR  IN  INTEREST  TO  ANY SUCH ORGANIZATION, for the acquisition,
 financing, refinancing, construction, reconstruction, renovation, devel-
 opment, improvement, expansion and  equipping  of  certain  educational,
 administrative, residential, clinical [and], day programming, JOB TRAIN-
 ING  AND  WORKFORCE DEVELOPMENT facilities to be located in the state of
 New York.
   § 2. The two undesignated paragraphs of subdivision 1 of section  1680
 of  the public authorities law, as amended by chapter 580 of the laws of
 2003, are amended to read as follows:
   Not-for-profit members of the New York  State  Rehabilitation  Associ-
 ation  AND  THE  NEW  YORK ALLIANCE FOR INCLUSION AND INNOVATION AND ANY
 SUCCESSOR IN INTEREST TO ANY SUCH  ORGANIZATION,  for  the  acquisition,
 financing, refinancing, construction, reconstruction, renovation, devel-
 opment,  improvement,  expansion  and  equipping of certain educational,
 administrative, residential, clinical [and], day programming, JOB TRAIN-
 ING AND WORKFORCE DEVELOPMENT facilities to be located in the  state  of
 New York.
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

   Notwithstanding  any other provision of law, not-for-profit members of
 the New York State Rehabilitation Association AND THE NEW YORK  ALLIANCE
 FOR  INCLUSION  AND INNOVATION AND ANY SUCCESSOR IN INTEREST TO ANY SUCH
 ORGANIZATION, with the concurrence of the APPLICABLE  association  shall
 have  full  power  and  authority  to assign and pledge to the dormitory
 authority, any and all public funds to be apportioned or otherwise  made
 payable  by the United States, any agency thereof, the state, any agency
 thereof to the extent permitted by  law,  a  political  subdivision,  as
 defined  in section one hundred of the general municipal law, any social
 services district in the state or any other governmental  entity  in  an
 amount  sufficient  to  make  all  payments  required to be made by such
 members pursuant to any lease, sublease or other agreement entered  into
 between  such  members  and the dormitory authority. All state and local
 officers are hereby authorized and required to pay  all  such  funds  so
 assigned  and  pledged to the dormitory authority or, upon the direction
 of the dormitory authority, to any trustee of  any  dormitory  authority
 bond  or note issue, pursuant to a certificate filed with any such state
 or local officer by the dormitory authority pursuant to  the  provisions
 of this section. The New York State Rehabilitation Association's respon-
 sibilities  AND THE RESPONSIBILITIES OF THE NEW YORK ALLIANCE FOR INCLU-
 SION AND INNOVATION AND ANY SUCCESSOR IN INTEREST TO ANY SUCH  ORGANIZA-
 TION, in relation to any lease, sublease, or other agreement between the
 dormitory  authority  and  the  APPLICABLE  association's  members shall
 include, but not  be  limited  to,  coordinating  and  facilitating  any
 required  financial disclosure and any other matters heretofore or here-
 after deemed necessary or appropriate.
   § 3. Section 5 of chapter 371 of the laws of 1998, amending the public
 authorities law relating to the construction and financing of facilities
 by the dormitory authority for the New York State Rehabilitation Associ-
 ation, as amended by chapter 278 of the laws of 2013, is amended to read
 as follows:
   § 5. This act shall take effect immediately and shall  expire  and  be
 deemed repealed on December 31, [2018] 2023.
   §  4. This act shall take effect immediately, provided that the amend-
 ments to the undesignated paragraph of paragraph (b) of subdivision 2 of
 section 1676 of the public authorities law, made by section one of  this
 act,  and  the amendments to the two undesignated paragraphs of subdivi-
 sion 1 of section 1680 of the public authorities law,  made  by  section
 two  of  this  act,  shall  not affect the expiration and repeal of such
 undesignated paragraphs pursuant to section 5 of chapter 371 of the laws
 of 1998, as amended, and shall expire and be deemed repealed therewith.
