PEOPLES-STOKES, BURKE, McMAHON, RYAN, WALLACE -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend chapter 5 of the laws of 1997 relating to the creation of the Roswell Park Cancer Institute corporation and providing for the rights, powers, duties and jurisdiction of such corporation, in relation to procurement contracts awarded by the institute THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 15 of chapter 5 of the laws of 1997, relating to the creation of the Roswell Park Cancer Institute corporation and providing for the rights, powers, duties and jurisdiction of such corpo- ration, is amended to read as follows: § 15. Notwithstanding any inconsistent provision of subdivision 2 of section 2879 of the public authorities law, for the purposes of the application of such section to the Roswell Park Cancer Institute corpo- ration created pursuant to section two of this act, procurement contracts shall mean any written agreement for the acquisition of goods or services of any kind, in the actual or estimated amount of ONE HUNDRED twenty-five thousand dollars or more. Notwithstanding any incon- sistent provisions of article 4-C of the economic development law, procurement contracts awarded by the Roswell Park Cancer Institute corporation created pursuant to section two of this act, in an amount less than ONE HUNDRED twenty-five thousand dollars shall not be subject to the provisions of such article. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11420-01-9
