TITLE OF BILL:  An act to amend chapter 5 of the laws of 1997 relating
to the creation of the Roswell Park Cancer Institute corporation and
providing for the rights, powers, duties and jurisdiction of such corpo-
ration, in relation to procurement contracts awarded by the institute

 
PURPOSE OR GENERAL IDEA OF BILL:

The purpose of this bill is to provide Roswell Park Cancer Institute
with flexibility in its procurement, thereby allowing more resources to
be focused on its mission.

 
SUMMARY OF PROVISIONS:

This bill amends section 15 of chapter 5 of the laws of 1997 to provide
Roswell Park Cancer Institute a threshold of $125,000 for its discre-
tionary procurements.

JUSTIFICATION:

Roswell Park Cancer Institute, although a health care public benefit
corporation ("PBC"), it is uniquely different than other healthcare PBCs
such as Westchester, Nassau, and Erie Medical Centers because of its
distinct education and research enterprises. Medical equipment purchases
only represent about 10-15% of the Roswell's contracting activity. The
majority of Roswell's contracting involves research, academic and
prevention services that result in Roswell having a larger contracting
volume than its peer PBCs.

The procurement threshold proposed by this legislation is similar to the
lower end threshold imposed on SUNY facilities ($125,000).

This bill provides Roswell with the ability to reduce the significant
administrative costs associated with having to issue an RFP for some of
the lower valued contracts that Roswell procures.

Each RFP issued costs Roswell an average of $35,000-$40,000 in terms of
hours to administer.

This bill will not impact the requirement for Roswell to competitively
bid its more complicated and resource intensive contracts.

It is estimated that by adjusting Roswell's procurement threshold, it
could save Roswell approximately $500,000 annually, and free up staff
and resources to continue to pursue the research and academic mission of
Roswell.

EFFECTIVE DATE:
This act shall take effect immediately.

 AN  ACT  to amend chapter 5 of the laws of 1997 relating to the creation

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 15 of chapter 5 of the laws of  1997,  relating  to
 the  creation  of  the  Roswell  Park  Cancer  Institute corporation and
 providing for the rights, powers, duties and jurisdiction of such corpo-
 ration, is amended to read as follows:
   § 15. Notwithstanding any inconsistent provision of subdivision  2  of
 section  2879  of  the  public  authorities law, for the purposes of the
 application of such section to the Roswell Park Cancer Institute  corpo-
 ration  created  pursuant  to  section  two  of  this  act,  procurement
 contracts shall mean any written agreement for the acquisition of  goods
 or  services  of  any  kind,  in  the  actual or estimated amount of ONE
 HUNDRED twenty-five thousand dollars or more. Notwithstanding any incon-
 sistent provisions of article  4-C  of  the  economic  development  law,
 procurement  contracts  awarded  by  the  Roswell  Park Cancer Institute
 corporation created pursuant to section two of this act,  in  an  amount
 less  than ONE HUNDRED twenty-five thousand dollars shall not be subject
 to the provisions of such article.
   § 2. This act shall take effect immediately.
